OK this drama has ended with my pants around my ankles and not being able to sit. So I go in today and hands me the letter of dismissal but instead of being this Friday it is dated for April 29th. I take a look at it and throw it right back at her saying i wont sign it, because she originally didnt give me the 30days necessary. I think she understood she would lose there if I went to the Labor Board and decided to employ me for another month. She said she called the new teacher and told him to come next month.
I told her i wont sign it and ill still be leaving this friday unless she agrees to pay me my severance(at least 11/12th) of it and my airfare(11/12th) of it. She says she needs to talk to her lawyer, and we can talk at the end of the day.
So after classes, she says that legally she doesnt have to give me anything because she has grounds to fire me, and legally she can if I go to the LB/LRC and I lose, i would have to pay for the academy's lawyer fees/training fees,housing fees and all this other BULLSH8T. At this point I dont doubt a word she says because they are one of the biggest acadamies in Korea.
She said shes willing to write me a LOR if I finish April well and 500,000won(half airfare). Either way it was a lose-lose, just picked the one i lost less...

Get it in writing. Really. She wouldn't have promised half airfare unless there were a decent chance that the company would lose in court (for wrongful dismissal). If it's not in writing, it was just a speculative conversation that you had.

If a boss has decided they don't like you, for whatever reason... then nothing you do will be able to "fix it."

If you've arrived at the extraordinary situation that the boss has given you several verbal warnings...then its blatantly obvious they're preparing to get rid of you when the most convenient moment arrives.

In such a situation..probably better to leave early on, on your own terms.. rather than wait around to be disposed of on their terms.

OP: its a lottery when you're applying from overseas, but now you're in korea, you'll be able to choose at interviews a nice boss that you click with.

to be honest, it's not a bad result, you got another month's work and 500,000 out of them. Most people would have rolled over and left.

I know it's not ideal, but it's better than getting fired and not getting the money you are owed, let alone the 30 days notice you've received.

Hopefully you get something better in the future, good luck with it.

It hasn't been said yet, but if she's firing you, she can't just turf you out of the apartment immediately. There are eviction laws here, too, and she has to give you notice there, as well.

Do you have any other skills? I got fired at the start of the month and I'm already in a better, professional job with an E-7 visa. Think of it as a path to a better job.

I was reading a story the school tried to sue the teacher because she didn't want to work because the contract agreement was not correct.

Panhandle outside of the school for the other half of the airfare. Have a sign that says in Korean, "Homeless teacher of (insert name of school here) needs airfare out of Korea and a few won for food." I think she'd cough up the other half.

OP - That isnt a bad deal. Hard to swallow but not too bad. Where are you from by the way? 500K won (459 U.S) is not half airfare anymore for many places. If you're going to take the LOR and stay, take the 500k. If not, bring in an expedia list of airfare and demand HALF. Granted, I was looking at NYC prices, cheapest 1 way is around 1,200 on short notice.

I know its only a few hundred bucks but if she wants to be a jerk, be a jerk back. Also, a month working knowing you've been fired WITH the qualifier of 'if you work well' would suck bad.

You could also just take the money and take a long vacation : )

The school didn't do anything wrong in the end. They hadn't thought it through, and they should have, but once it was pointed out that they were required to give 30 days notice or pay, they complied. Airfares are a grey area unless the contract is specific - half is a reasonable compromise - and a LOR too. They aren't being vindictive or anything.

The OP had no right to refuse the 30 day notice. After that point, they were the ones being unreasonable.. edit: -snip- & add: ... by withholding compliance to gain leverage in the matter of airfare and severance. Not judgin', just sayin'.


If we can take anything away from this, it might be that if your boss says they are going to fire you, ask them politely if they can really afford ($) to fire you right now, and mention the 30 day pay or notice contract clauses. It might cause a law abiding employer to reassess, before harsh words are spoken. Otherwise, take your 30 days, and move on.

I'd go to the Labor Relations Commission and file a complaint for unfair dismissal. If she put April 29 on the dismissal letter then you have time to have it all successfully soughted out through the Labor Relations Commission. They'll reinstate you. And you can continue working until the end of the contract and get your severance pay plus return airfare. You'd need someone who can speak Korean fluently to go with you when you file a complaint.
