Quote:
Apple has sued Samsung for allegedly copying the iPad, iPod and iPhone with its Galaxy Tab and Galaxy handsets.

Samsung copied Apple technologies, designs and even packaging with its Google Android-based products, according to a complaint filed Friday in the U.S. District Court for the Northern District of California. Apple is seeking a jury trial in the case.

"Instead of pursuing independent product development, Samsung has chosen to slavishly copy Apple's innovative technology, distinctive user interfaces, and elegant and distinctive product and packaging design, in violation of Apple's valuable intellectual property rights," Apple said in the complaint.

Late last year, Samsung became the first major consumer electronics maker to roll out a tablet to compete with the iPad. It is also one of the world's largest makers of mobile phones, especially handsets that use Android.

The complaint includes 10 charges of patent infringement, two of trademark violation and two of trade dress violations, plus unjust enrichment and unfair business practices. Apple named Samsung Electronics, Samsung America and Samsung Telecommunications America as defendants. The case was filed at the district court in San Francisco but is being transferred to Magistrate Judge Laurel Beeler at the court's Oakland, California, location.

A spokesman for Samsung in the U.S. said the company had no comment on the lawsuit. Apple officials could not immediately be reached for comment.

The allegations span a broad range of Samsung's mobile devices, including the Epic 4G, Captivate, Indulge, Nexus S and Galaxy S 4G smartphones as well as the Galaxy Tab. Apple singled out the Galaxy product line for criticism.

"The copying is so pervasive, that the Samsung Galaxy products appear to be actual Apple products -- with the same rectangular shape with rounded corners, silver edging, a flat surface face with substantial top and bottom black borders, gently curving edges on the back, and a display of colorful square icons with rounded corners," the complaint said.

Apple wants an injunction to stop Samsung's alleged intellectual property violations, along with actual and punitive damages, Samsung's "wrongfully obtained profits" and funds for corrective advertising about the allegedly confusing products.

I think Samsung makes excellent products (I own a Galaxy phone), but it's clear that they copied Apple just like everyone else copied Apple including Google, Motorola, HTC, list goes on and on. Apple created the touch screen mobile market.

Of course Apple is taking it to the 500 pound gorilla that is Samsung in order to get a big settlement out of it. They're not going to really stop Samsung though, mind you, this is a company that turns over 120 billion USD a year.

Korea doesn't have creativity. They just copy other companies. Apple is JUST realizing this?

Apple knew all along but are now getting sick of the Koreans going around the world saying how Samsung is best. number 1 and insulting the Ipad.

Apple buys billions of dollars of parts from Samsung every year. They have a healthy love/hate relationship.

In any case, Apple is just ramping up the marketing/media campaign just prior to the massive tablet war in the 2H of 2011.

The same could be said about the Americans in the 1840s, Japan in the 1860s and Germany in the 1870s. All states have and still do copy to catch up.

I hope Apple wins. The line has to be drawn somewhere. Then on to China.

If Apple wins, I guess they can still sell their Galaxy crap in Korea but in USA they will have to pay a large settlement and royalties or pull it from the market.

Silly comparison.

Has Korea invented anything modern? I can't think of a single thing. Anyway, their role of producing cheap semi-conductors, container ships etc. has been a useful one.

I still think Samsung phones suck though (I've owned two in my life, both broke down randomly, I would never buy another one). Basically I dislike Samsung products in general.

Yeah, Samsung is basically just a wholesale semiconductor producer for the rest of the electronics industry (esp. for Japanese companies). That's their bread and butter.

China and many EU countries adopted the Korean DMB (Digital Multimedia Broadcasting) system for their mobile television standards.

I like Samsung because the Canadian telecommunication scene is still big on Samsung.

They didn't invent them of course but Samsung make very good HD TVs. I've never used a Galaxy phone but have heard good things about them, although I think I understand where vistorhq is coming from. I never liked their phones before. I have used an iphone and ipad and was impressed to although I personally wouldn't shell out that kind of money on one of them. Dont really need it. However I have a Macbook Pro and it's honestly one of the best pieces of electronic equipment ive ever owned, if not the best. I just find it such a breath of fresh air after my HP laptop.

Anyway, of course Samsung copied Apple, everyone is.

Apple is leading the way in innovation, that's why they have been so successful and keep growing. They made MP3 players popular, smartphones and tablets. Their computers are always gaining popularity.

It's about time more companies started taking a leaf out of their book and coming out with their own ideas, otherwise you will just see Apple continue to steal the show.

+1

Apple products are a bit overpriced IMO, but at least they're really good. You could buy a cheaper PC/laptop with more technical bang if you knew where and how to customize everything, but it still probably wouldn't operate as smoothly or reliably as a Mac. Mostly I just despise Windows and think the Mac software performs a hundred times better, with way less hassle. More than anything the software is the main reason why I'd probably get a Apple smart phone instead of something from Google...

Did Germany? Did Japan? Did that matter?

Companies copying one another is good for society. It should be encouraged, not condemned; success should be emulated.

Apple used their position to force Itunes upon people.

Engineering-wise, they win.

In market control, Microsoft wins.

Google bats clean-up and wins the war (as opposed to the battle).

This has repeated itself more than once now:

Microsoft gave you 2MB of memory for email.
Apple forces you into their proprietary system.

Asus forced both of them out of happy perches peddling laptops like they needed to cost 2k+.

Netbooks, of course, weren't Samsung's idea, but it wasn't like Apple just pulled the IPad out of their behind.

They were forced into it (meeting market demands for cheaper hardware).
