A New Jersey woman was stabbed in the face with a pen on a New York City subway train after she tried to stop a man from lighting a cigarette.
The assault occurred on a crowded No. 3 train near the Chambers Street station during Tuesday's morning rush.
Witnesses told the Daily News and the New York Post that an argument quickly escalated when Evelyn Seeger asked the man not to smoke. The witnesses say two riders were trying to restrain the man when he pulled out a pen and slashed Seeger's face.
Seeger, of Nutley, N.J., was treated at a hospital and released.
Police charged the man with felony assault and criminal possession of a weapon.

I know this is New York and all, but maybe we're not getting the whole story.

I'd venture to say the charge results from him using the item in question as a weapon and inflicting injury by using it as such.

Well, as a correction to all the smokers out there, turns out this guy was a pothead. Here's a new article from the NY Daily News:

No one gets between Coroberto Cordero and his weed.

That's what the assault suspect told cops after he was busted for stabbing a straphanger with a pen because she objected to his smoking on the train, court papers show.

"I was just trying to light my blunt, and the b---h wouldn't leave me alone, so I hit her," Cordero told transit cops, court papers released Wednesday charge.

Cordero, 35, faces felony assault and marijuana possession charges - and up to seven years behind bars - for the Tuesday attack on a southbound No. 3 near Chambers St.

Evelyn Seeger, 45, of New Jersey, ended up with a gash to her head that required four stitches, officials said.

Witnesses said the argument between Cordero and Seeger quickly escalated as he waved a flaming lighter in her face while she yelled at him.

"Leave me the f--k alone or I'll stab you," Cordero threatened Seeger before pulling out a pen, prosecutors said.

Other riders tried to restrain Cordero, who threatened to come back with a knife, Assistant District Attorney Rachana Pathak said.

Cordero was arraigned in Manhattan Criminal Court and ordered held without bail after Manhattan prosecutors told a judge he has a violent history - which his lawyer disputed.

The suspect had nothing to say, but city straphangers had plenty of opinions about the underground dustup.

Gerard Fraser, 42, a 6-foot-6, 220-pound security guard from Staten Island, said he would have done just what Seeger did.

"If it were me? I would tell him to put it out," said Fraser. "Be courteous to those around you. Wait a few stops, then smoke your cigarette.

"Good for her for saying something. There seems to be a lack of civility in this city now. It's a selfish act, what he was doing."

But Katiana Kersaint, 17, a high-school sophomore from Canarsie, Brooklyn, said she would rather be silent than sorry.

"I wouldn't say nothing because I don't know how he would react. You just never know with people," she said.

"It would bother me, but I would move away, down the train."

Joe Rizzo, 49, a public high-school teacher from Garden City, L.I., said he wasn't sure.

"When I was younger, I was hell on wheels, and I would have been right in there. But the last 10 years? It's karma," he said.

"I see this kind of disrespectful attitude every day in schools. The students, they are outta control. Like this guy, no respect for nobody."

A fist can be a weapon. One punch and you can fall over and crack your head open and die. It happened in my city last year, in fact. A pen isn't a sword or a gun, but imagine he stabbed her in the eye, or the jugular. What then?

I've been in my share of waegookin fights and you better believe I treat every punch thrown like it's a killer.

A fist isn't an implement. A pen is an implement and, apparently, when used intentionally to cause physical harm to another, is a particular type of implement known as a weapon.

Maybe if he's penitent the judge will go easy on him.

If he keeps on making statements like that at least he might end up as an internet celebrity.

Either way this may turn into one of the more entertaining threads on Dave's this year.

I hope that cigarettes cost around $50 a pack one day. That would stop all you idiotic smokers out there. Or at least slow you down because you probably would be foolish enough to continue buying. Smoking needs to be stamped out completely.

Same with alcohol right? That worked out well last time we tried it. How bout that war on drugs?

And FYI, the guy was smoking a blunt.
