Is the 13 month rule effective immediately for E2's? If my contract finishes in a couple of months, can I now stick around for an extra month with no penalty? Are the changes in effect now or do they only apply on our next visa? Anyone know the score? |

No. You still have to exit by the date indicated on your ARC. If you plan to stay past that date you need to get the free extension of departure from immigration with your outgoing plane ticket.
New hires and renewals from 2011 automatically get the extra 30 days (and it's shown on their ARCs). |

I renewed in September of 2010 and got the automatic 13 months on my ARC and visa. My question is, can I still get that free extension of a month past the 13 months? Essentially staying for 14 months, or does that 13 months on the visa and ARC null that old system? Any info would be appreciated. Thank you. |

If you got 13 months, the 13th month is your extension. You'd have to ask/try with immi and you 'll need the outgoing ticket.....but call 1345 and ask before you book the ticket. You also cant work during that 13th/14th month. |

I understand that it is an extension of sojurn, not an extension of my visa. I will call the immi line several times to see the answers I get. I know I wouldn't be able to work that 14th month, however my visa and ARC both cover 13 months so now I am very curious about that automatic 13th month and my ability to work in that 13th month. |

Your 13th month is non-working. It allows you to settle your affairs and/or find a new job job to transfer to - the new rules allow for a transfer without an LOR at the end of your contract if there is time remaining on your visa. It is not for work purposes. Consider it the 30 day non-working extension that is given without the request or plane ticket. If you want to work for the 13th month, you need to apply for an extension of sojourn, before the end of your 12th month, with a new contract that covers your 13th month or however much longer you want to work at that job. |
