I've just given notice after 10 months at my GEPIK elementary.
My school said I must pay back the 300,000 settlement allowance!

But my contract states: If employee worked for more than 6months the employee's obligation to pay back airfare and settlement allowance of 300,00won shall be waived by employer.

My handler is trying to find out the correct current policy. She has a recent GEPIK guidelines book that says I must pay it back! So has the policy been changed recently?

What should I do?

Even IF the policy had been changed your contract would override the policy handbook.

You do NOT have to repay the settlement allowance NOR do you have to repay your airfare.

You ARE entitled to your deposit back (less any outstanding debts you leave for the school (like utility costs).

If she gives you any more grief over it, contact GEPIK at the Suwon office (policy division).

You don't have to pay that settlement allowance. I quit my GEPIK school within 6 months, and I had to pay back that settlement allowance.

I'll say it's most likely that your VP and/or your co-teacher are threatening you.

I think I said this before. Friends don't let other friends apply to GEPIK.

Thanks heaps for your quick, supportive responses guys! Just been told I don't have to pay it back after all! Hope if anyone is in a similar situation, they get it sorted out!

Sounds like something more serious came up in order to be leaving after 10 months and worrying over just 300,000 with a recruiter involved as well.

I would be addressing that instead.

What happened? Two months isn't too long if you consider that it's for three months pay (with the bonus).

Hopefully no one out there in GEPIK falls for that BS.

That GEPIK "handbook" creates so many problems in situations like this one. I know all about it. My school had one that claimed GEPIK teachers only get 12 days of vacation time. They also claimed some nonsense about the flight ticket reimbursement. The contract overrides some stupid "manual" that is full of mistakes.

They're trying to use the 2011 contract on you, which does state that if you leave at ANY TIME during your contract you are required to repay the 300,000 settlement fee (airfare is waved after 6 months, per usual). However, if you have been there 10 months, you most certainly signed the 2010 contract which states you don't have to pay back the settlement fee after 6 months. I have a feeling I may have to battle this also because I signed my contract in December (thus signed the 2010 contract) but didn't end up coming until Jan. I am now getting ready to give my notice (around/after my 6 month mark) and have a feeling they may try to pull the same crap. However, the contract I SIGNED is the 2010 one. No one ever asked me to sign a new one when I got here (I even told my co-teacher there was a new 2011 contract). Good luck OP! It's in your contract, they're just bullying you.

It doesnt matter when you started, all that matters is what the contract that you signed says.

It also doesnt matter why the OP is leaving, the question is whether or not the school can ignore the contract.

The contract you signed is the correct one for your employment period. Your employment period began in the 2010 academic year. That academic year runs from 1 March 2010 to 28 February 2011.

If an employer fired a teacher at the 10 month mark or 11th, you would be raising the red flag. When the employee does it, keep silent? Maybe if you are the teacher, but you and I aren't in this case. The OP is. So, what's the story? Just as I would ask the employer, I ask the employee.
