Hi all,
I'm a newbie here and I'm in need of some real and objective advice about the following contracts I'm being offered from various Hagwons including SLP Changwon, Jungchul Yangsan, Gwangju and SEI in Daegu. I did get a decent and well rounded insight from a soon to be leaving teacher at one of the above places, and waiting to see what transpires from the other native teachers. I also got an amazing testimony from a teacher at another place while the boss was right beside her, which gave me the shivers alright!
Having read through a reasonable amount of advice offered on here I have an idea of the things, which should be clearly stated on a "given" contract, what I should be looking for and what kind of words might warrant alarm bells! As realistic as I am I'm not going to settle for some crappy contract, which will allow the "employer" or can I say some shaddy Hagwon boss to run rings around me. However, I'm also getting the impression that finding a "relatively" decent contract from a Hagwon might take a little bit more work.
To the savvy and experienced heads out there I'd really appreciate your thoughts, advice and dissecting of these contracts. Whatever else you think I should watch out for before putting pen to paper and signing my life away please let me know!

CONTRACT 1:

EMPLOYMENT AGREEMENT
This employment agreement is made by and between the following parties:
Employer : _ XXXXXXXX_ School, XXXXXXX Campus
Employee : XXXXXXXX
Above-mentioned parties agree as follows:
1. JOB DESCRIPTION
The employee will be responsible for conducting professional, well-planned English language classes. The employee may also be assigned by the Director to other education related duties, such as teachers� meetings, staff training sessions, workshops, daily schedules, report cards and new student interviews. The employee may also be required to be present in uniform attire at marketing events, for which the employee will be compensated at the following rates: 20,000 won/hr for events held outside the campus, 20,000 won/hr for events held inside the campus.
2. WORKING HOURS
Teaching hours are normally 6 hours per day excluding one hour prep time. These hours are subject to change due to public school sessions, school summer and winter vacations, and others. The employer retains the sole right to schedule the employee based on the requirements of the employer.
3. PLACE OF EMPLOYMENT
The employee will be employed at XXXXXXXX School, XXXXXXX Campus.
4. SALARY
4.1 The employer shall pay the employee a salary of 2.2 Million won per month. The employee will be required to provide 30 hours of classroom instruction per week. The employee may be required to perform administrative duties as part of these hours. The employee will also be expected to put in additional time necessary to prepare for classes and to be present at teachers� meetings.
4.2 ALL overtime must be agreed to by the Director and the employee PRIOR to any being taken. Payment for overtime work is subject to agreement between the Director and the employee. If no separate agreement is negotiated, the employee will be paid at a rate of 20,000 won per hour.
4.3 Korean income taxes (3.3%) will be withheld from the employee�s salary every month as per Korean income tax law.
4.4 Employee will be enrolled in a private health care plan 50% of which is paid by the employee and 50% of which is paid by the employer.
5. BONUS
In lieu of severance pay, a bonus of 2.2 Million won will be paid to the employee at the end of contract year after all outstanding bills and obligations are paid.
6. SALARY PAYMENT DAY
The salary will be paid to the "Employee" once per month without delay on the 10th of each month. The payment will include services rendered from the 1st to the 31st (or last day) of the previous month.
7. ACCOMMODATION
7.1 The employer will select and provide furnished living accommodation for the employee.
7.2 The accommodation will be in a single villa or apartment. The employer shall provide basic furniture items and appliances such as a bed, a TV, a kitchen table and chairs, a refrigerator, a washing machine, a gas stove and a telephone (not service) plus some utensils.
7.3 The employer will pay the rent for the apartment. The employee will pay for utilities such as power, water, gas, heating and telephone costs.
8. VACATION
8.1 The employee is entitled to ten business days of paid vacation per contract year; The employee will be allowed vacation that is indicated in the XXXXXXXXXX Campus schedule
8.2 The employee is allowed three paid sick days per contract year. The employee may be required to provide proof of illness to receive a sick day. Excess use of paid sick leave will not be permitted. The employee is entitled to National Holidays. Korean election days are not considered National Holidays for the purposes of this contract.
9. AIRFARE
The employer shall provide an economy airfare ticket from the employee�s point of hire to Seoul. Should the employee wish to return to home country upon satisfactory completion of the contract, the employer shall provide the employee with an economy airfare ticket
10. DUTIES AND RESPONSIBILITIES OF THE EMPLOYER
The employer will undertake all the pertinent steps and measures in order to obtain a residence visa and work permit (E-2) for the employee prior to their arrival in Korea. For this purpose, the employee will furnish the employer with all documents that the employer requests, such as the original or certified copy of their University degree, sealed transcripts and photos.
11. DUTIES AND RESPONSIBILITIES OF THE EMPLOYEE
11.1 The employee will dress and behave in an appropriately professional manner.
11.2 The employee understands and agrees that at all times during the term of this agreement, the employee will strictly adhere to and obey all laws and regulations of the Government of Korea (ROK) or any Korean local government officials.
11.3 The employee will not engage in sexual behavior or enter into a romantic relationship with a minor or any student of School.
11.4 The employee will not use or transport any drugs or other substances prohibited by the laws and regulations of ROK.
11.5 The employee will conduct himself/herself in a manner that does not detract from the reputation or the good name of the institute.
11.6 The employee must allocate sufficient time each day to plan their daily classes.
11.7 The employee must give written or oral notice if he/she is not to teach a class, at least one day in advance. Should the employee not teach an assigned class (without notification), the employee may be dismissed and this agreement terminated.
12. MISCONDUCT AND DISMISSAL
12.1 The employee will work only for the employer. Any other employment is in violation of Korean Law and will be considered a breach of contract and is a cause for immediate dismissal.
12.2 The employer has the right to dismiss the employee for neglecting their duties after being warned.
12.3 The employer will dismiss the employee for criminal conduct inside or outside the place of employment that would, in the opinion of the Director or vice-Director, seriously jeopardize any student or other employee.
12.4 The employer may dismiss the employee should the employee�s conduct damage or harm the reputation of the school.
12.5 The employee may be dismissed for financially harming the employer.
12.6 The employee may be dismissed for misrepresentation of academic degree or work related experience or qualifications.
12.7 In case the employee is dismissed for any of the above enumerated reasons, bonus payment and expenses shall be treated as mentioned in Clause 14 (�Resignation�) below.
13. RE-ASSESSMENT OF THE EMPLOYEE
The employer has the right to re-assess the employee should the teaching hours of the institute not be sufficient for the employee�s retention. The employer will give the employee 4 weeks notice if such a case arises. The employer will retain the sole right as to which employees will be laid off. Should such a situation arise the employee�s bonus will be prorated but the employee will not be liable for any costs associated with the hiring process, including recruiting fees and airline ticket costs.
14. RESIGNATION
Should the employee voluntarily resign prior to the termination of the term of this agreement, the employer will not be obligated to pay the employee any part of the bonus. If the employee voluntarily resigns before 6 months of this contract have been completed, employee is responsible for repayment of the cost of airfare to Korea. Employee must provide a minimum of 1 month�s notice when terminating the contract. In a case where the employee does not provide 1 month�s notice, up to1/2 of the last month�s salary may be deducted to cover damages associated to not having enough time to find a replacement teacher.
15. RENEWAL OF CONTRACT
Three months before the expiration of this contract, both parties should notify each other as to whether or not they will renew this contract for another year. The parties will then renegotiate the salary and terms of employment for the following year.
16. CONTRACT LENGTH
This contract is valid for one year and shall commence with the first day of employment.

CONTRACT 2:
EMPLOYMENT AGREEMENT
This EMPLOYMENT AGREEMENT becomes effective on xx xxxxxx 2011 between X X X Language Institute with its principal office at(full address I�ve deleted for obvious reasons) (hereinafter referred to as the "Employer") and , a citizen of , passport no: , (hereinafter referred to as the "Employee"). The Employee is hereby hired by the Employer and both parties agree on the following terms and conditions:
1. Period of Employment
1.1. The total agreement term is 12 months. (XXXXX XX 2011 ~ XXXX XX 2012)
1.2. The term of this Agreement includes an orientation period, twelve (12) consecutive teaching sessions, and all scheduled vacations and holidays that fall between or during teaching sessions.
1.3. The Employee will discontinue residence in Korea under the visa status sponsored by the Employer upon the completion of this contract unless the both parties agree to renew the contract.
2. Conditions of Employment
2.1. Employee�s Duties: During the term of this Agreement the Employee will perform the following duties:
2.1.1. EFL instruction in any phase of the Institute's program.
2.1.2. Grading
2.1.3. Evaluation
2.1.4. Counseling
2.1.5. Class preparation and teachers� meeting. (1 hour prior to first class).
2.1.6. Other related activities.
2.1.6.1. Saturday field trip or event for students 6 times
2.1.7. Keeping his/her classroom neat.
2.1.8. Interview new students and evaluate their placement level.
2.2. Working hours
2.2.1. Classes will be held from Monday to Friday.
2.2.2. Working hours are from 2:00 p.m. to 9:00 p.m. (2:00 p.m. ~ 3:00 p.m. : Preparation time, 3:00 p.m. ~ 9:00 p.m. : Teaching time)
2.2.3. The Employee will be required to work at the times the Employer shall direct already outlined in the contract.
2.2.4. The employee will not be permitted to leave the Institute during the working hours even if he/she has no classes.
2.3. Salary and Overtime
2.3.1. The Employee will be guaranteed 2,200,000 KRW per month.
2.3.2. Only the time worked in excess of contract hours will be considered as overtime. The Employee�s overtime pay will be 18,000 Won per 60 minutes. Attendance at other related activities, staff meetings, workshops and class preparation (which is mandatory) will not be considered as overtime.
2.3.3. The salary will be paid on the 10th day of the next teaching month.
2.4. Severance Pay
Upon successful completion of a full contract period 12 months, the Employee will be given severance pay which is equivalent to his/her salary of 2,200,000 Won.
2.5. Benefits
2.5.1. Housing
2.5.1.1. The Employer will select and provide free furnished living accommodation for the Employee usually located not far from the school.
2.5.1.2. The accommodation will be a private apartment studio.
2.5.1.3. The Employer will also provide furnishings which include: bed, two-burner gas hot plate, air conditioner, refrigerator, washing machine, TV set, microwave oven.
2.5.1.4. The costs of all utilities (gas, water, electricity, cable TV) and a monthly apartment maintenance fee will have to be paid by the Employee.
2.5.1.5. The employee must move out the next day of the actual last teaching day.
2.5.2. Vacation, Holidays, Sick leave and Emergency Leave
2.5.2.1. The Employee can get 10 days in total for a paid vacation while the Employee is under the contract. The employee will take 5 days in the summer according to the schedule and the last 5 days of the contract. There will be no winter break. Therefore, the employee shall terminate the contract 5 days earlier than as is stated on the contract to compensate for the winter vacation. This will not affect the severance pay in any way. National Holidays, Saturdays and Sundays shall not be included in a paid vacation.
2.5.2.2. The Employee can take 3 sick days off. In case of exceeding 3 days of illness, the Employer may deduct a day's pay for every day the Employee is absent from work. The Employee must notify the Employer at least five hours before class time of illness. In this case, the Employee must show the doctor's note of illness.
2.5.2.3. The Employee can take 5 days of unpaid �Emergency Leave� for use in case of death in the family or other emergency. In this case, the Employee must show the proof of death / other emergent situation.
2.5.3. Health Insurance: The Employee will be provided with health insurance coverage from the designated public health insurance corporation with 50% of the premium paid by the Employer and 50% - by the Employee.
2.5.4. Transportation: The Employer will purchase for the Employee an economy class air ticket to Korea from a main international airport in the country/city where the Employee resides and from which the employee was hired. After completing a one-year contract the Employee will be provided with a return economy class air ticket to his/her home country.
3. Taxes and Other Deductions
3.1. The following taxes and deductions will be withheld from the Employee�s monthly salary.
3.1.1. Income tax required by the Korean Tax Law;
3.1.2. National Pension Contribution according to regulation
NOTE: Upon completion of the contract (agreement), pension contributions will be fully reimbursed to the Employee by the Korean government;
3.1.3. Health Insurance;
3.1.4. 200,000 Won will be deducted for each month for the first three months as a security deposit for unpaid utilities even if the Employee pays them each month. This deposit WILL BE refunded to the Employee one month after this contract is completed.
4. Employee�s Conduct and Dress Code
4.1. During the term of this Agreement the Employee is expected to conduct himself/herself in a professional manner that would project a good image of the Institute. Therefore, the following forms of behavior will NOT be permitted:
4.1.1. Coming to the Institute and conducting class under the influence of alcohol or illegal drugs and while smoking;
4.1.2. Making sexual advances towards or entering into relationships with the students or employees of the Institute;
4.1.3. Using bad language in class that would offend or discredit students, the staff and the Institute.
4.1.4. Not following scheduled class timetables, canceling, starting classes late without the prior approval of the academic director.
4.2. The Employee should present himself/herself to students as a professional. Casual attire, provided it is clean and neat, is acceptable. However, NO blue jeans, sneakers and T-shirts will be allowed (unless otherwise instructed).
5. Duty of Confidentiality
5.1. The Employee shall not disclose information relating to the contents of lectures, teaching material and business operation of the Institute to any third party.
5.2. The Employee shall not disclose information regarding his/her salary, overtime payment, and contract hours to any third party, including other Employees of the Institute.
6. Outside Employment and Conflicts of Interest
6.1. According to Korean Immigration Law, foreign workers are allowed to work legally in Korea ONLY for the Employer/Institute for which they have received a work visa.
6.2. By signing this Agreement, the Employee agrees to devote his expertise, time and attention to discharge his duties to his legal Employer and not to engage in any other activity that would in any manner whatsoever compete with the Employer and pose any conflict between the interest of the Employer and the other party and/or interfere with the performance of the Employee�s duties.
6.3. If the Employee wishes to accept any other employment, such as private or part-time teaching, editing and so on, he/she must get the Academic Supervisor�s approval before doing so. Failure to comply with this rule may result in immediate dismissal.
7. Dismissal, Voluntary Resignation and Liquidating Damages
7.1. The Employer will have the right to dismiss the Employee if or when:
7.1.1. The Employee repeatedly fails to perform his/her duties stated under this Agreement including but not limited to frequent absences from the place of Employment/Institute without approval of the Academic Supervisor.
7.1.2. The Employee fails to conduct himself/herself in a professional manner (as described in Employee�s Conduct and Dress Code section of this Agreement) resulting in damaging the image of the Institute.
7.1.3. The Employee places any student or a staff person in jeopardy or causes significant material damage to the Employer as a result of his/her negligence or reckless behavior.
7.1.4. The Employee commits any criminal act inside or outside the place of employment/Institute. This will result in immediate dismissal with neither warning nor time for remedy being given to the Employee.
7.1.5. The Employee has already received three (3) reprimands (warnings) from the Employer of dissatisfaction with the Employee�s performance, and the Employee has not rectified the situation.
7.2. The Employee may not earlier terminate this Agreement without a good reason. If required, 45 days prior notice must be given to the Employer before termination of the contract.
7.3. In any case of dismissal or voluntary resignation, the Employer will not provide a return ticket and will not give the severance pay. In addition, if the Employee voluntarily terminates this contract before six (6) months of employment, he/she will have to reimburse to the Employer the initial airfare and other expenses that the Employer has incurred in the process of hiring of the Employee.
8. Understanding
8.1. Both parties have read the above terms and conditions and agree to fulfill them in good faith and will resolve any dispute in a reasonable manner.
8.2. All issues that cannot be solved by the two parties above will be solved in accordance with the appropriate laws of the Republic of Korea.

CONTRACT 3:
Letter of Agreement
The XXXXXXXXXXXX (hereafter �The Institute�) under the license of XXX (Corp) XXXXXX University and XXXXXXXXX (hereafter �the Teacher�) agree to a contract for regular full-time English teaching as follows:
TEACHER OBLIGATIONS
A. Supervision
The teacher will work closely with academic supervisor and other colleagues in the planning, observation, and review of instruction.
As a member of the Institute, the teacher will contribute to the cumulative experience, wisdom, and resources of a team dedicated to developing, implementing, and evaluating a comprehensive program for teaching English to Koreans.
B. Behavior
The teacher should respect the rules and standards of conduct of the Institute (written, verbal and tacit) and obey the laws, regulations, instructions, and ordinances of the national and local governments.
Any teaching or employment other than at the above address shall not be permitted, in accordance with Korean Law. Non-compliance may result in discipline including fines and deportation.
C. Workload
The Teacher will have at least 21 (80-minute, usually separated into 40 min classes) classes per teaching week. The Teachers are expected to devote no less than 2.5 hours a day at the Institute for lesson planning, student evaluations, teachers� meeting, consultation with parents, and supervision of play. Upgrading one�s professional knowledge and skills is without additional pay. The workweek will follow the yearly academic calendar issued by XXX (Corp) XXX Univ. Staff meetings will be scheduled at the discretion of the Institute Director. Attendance is required. Staff meetings will allow time for discussion of topics of current concern within the program such as new policies, procedures, method of training, instruction, curriculum, and other matters as needed. Staffs are encouraged to help work out practical solutions to problems at these meetings. The preparation and attendance for special events such as Field Day, Halloween Party, Speech contest, Program presentation, etc. demands the teacher to stay in school or at the place for several Saturdays and the request for the attendance is at the sole discretion of the institute.
D. Overtime
Over time teaching is paid beyond 20 (80-min) classes. Overtime will not be paid on holidays, sick days, or emergency leave days. The assignment of overtime above the regular 20 classes and less than 23 classes is at the sole discretion of the Institute. The over time rate is 30,000 won per one 80 min class.
E. Work Schedule
The workweek runs from Monday through Friday in monthly periods. The teacher�s schedule will be assigned by the Institute Director. If the teacher has preschool morning classes, s/he begins at 9:30. If not, he begins at 11:00 and finishes at 8:00 pm, Monday through Friday. In case the Teacher teaches longer on Mon, Wed, Friday then s/he will finish earlier on Thu, Thursday for compensation. The teacher will be expected in the institute by 9:30 a.m. or 11:00 p.m. Additionally, the teacher is required to take special morning classes in the summer or winter vacation programs. The assignment of the special classes is at the sole discretion of the Institute. During this period, work start from morning and finish earlier. Usually, the winter vacation program runs in January and summer vacation program in August.
F. Special Research Projects
Any part of the Teacher workload can be converted into research and development work. The R&D will be any kind of academic activities like developing new teaching plans, materials, phone teaching etc.
G. Period of Contract
Although pay starts the day the Teacher starts Teacher Training Program, the effective date of this contract is the first teaching day, not training in the Institute. The total period of this agreement is approximately one year, commencing from the first teaching day to the last session day of the last month.(If teacher�s last teaching day is in the middle of a month, teacher contract finishes on the last session day of that month.) A delay in the Teacher�s arrival at the Institute, or in the opening of a new Institute may call for a re-negotiation of the contract period. When the length of stay needs to be extended for the teaching in the Institute, the Institute and teacher will visit Immigration office together for that.

H. Termination of the contract by the institute
The Institute reserves the right to terminate this agreement without notice for as serious causes as follows:
-Violation of the school principles or official agreement
- Intentional negligence in teaching causing serious complaints
- At the end of the contract period
- Disgraceful behavior or speech as a teacher
- Frequent arguments with colleagues or managers
- Other reasons of the management
I. Termination of the contract by the teacher�s resign
The teacher can resign due to personal matters. But considering the responsibility as a qualified teacher and the cost paid by the institute the teacher should pay the corresponding fee as compensation as follows:
-With notification sixty days in advance: the airfare
-Without notification in advance: the airfare, recruiting fee and other cost related to recruiting a substitute teacher
- Runaway: the airfare, recruiting fee for a substitute teacher and other suing related-cost for the financial damage to the institute
TEACHER BENEFITS
A. Monthly Salary
The Institute will pay the teacher a total monthly basic salary of each month. The monthly salary is based on a calendar month, not the monthly teaching session. Korean income tax, National Pension & Medical Insurance will be withheld from the monthly salary.
B. Housing
The Institute will provide each teacher a single studio house to be shared with other teachers : In this case, each Employee will be provided his/her own private room. The apartment will contain a TV, refrigerator, a washing machine, a fan or air conditioner, wardrobe, a gas range or hot plate, bed, dining table & chair, some eating & cooking utensils. The Employee is responsible for utility charges such as garbage, electricity, gas, water, telephone, guard, etc. After the contract has completed, the studio/house must be restored to the initial state and be inspected 24 hours before the teacher vacates the studio/house.
In the event the damage is due to the Employee�s negligence, the Employee will be charged for the accomplished maintenance. When it is damaged or not cleaned up the teacher must pay the fee needed to get it restored. .
The Employee agrees to deposit a total of 400,000Won during the first two months of employment as a housing management (200,000Won each month). This deposit is to cover unpaid monthly services, utilities, telephone charges and damages. Half of the deposit will be returned to the employee at the end of the contract, the other half will be remitted together with the severance pay if there are no outstanding charges.
C. Health Insurance
The teacher will be covered by Korean National Health Insurance. According to the government guideline for teachers, the monthly insurance charge will be shared by the Institute and the teacher. (half of 4.48% each). Coverage will be from the date of joining to Korean Medical Insurance Union, commencing approximately 3 to 4 weeks after the teacher�s arrival in Korean due to requirements of the immigration and taxation department. However, it is not mandatory for foreign teachers.
D. National Pension Plan
In accordance with Korean Law, all foreign workers employed by Korean businesses shall pay into the Korean National Pension Plan at the ratio stipulated by the Korean National Pension Law(9%). Half will be deducted against monthly earnings with the employer�s contribution of half (4.5%).
E. Paid Sick Leave and Emergency Leave
Documented sick leave and emergency leave will be paid for a combined total of twelve 80-min classes (within three workdays) a year in case of serious injuries or contagious diseases. The medial certificate should be submitted afterwards. The teacher should provide the institute with as much advance notice as possible, at least one hour before. Unused sick leave may not be converted into any cash payment. If it is found that the hours/days of absence reported as sick leave or emergency leave were not in fact for such purposes, related costs shall be subtracted from the following month's pay. The above leaves will be included in the period of medical care compensation according to the Article 78 of Korean Labor Standard Law.
F. Airfare
The Institute shall pay one way airfare between the nearest International Airport to the Teacher�s place and Seoul Korea. The return airfare is provided. One-way airfare is provided at the end of contract. When the teacher needs to go to Japan for E-2 visa trip, the institute shall pay round-trip airfare.
In case the Teacher fails to complete the contract by his or her own fault/reason, the teacher shall pay back to the Institute the total amount of the air tickets and /or the actual amount for the visa trip to Japan..
G. Teacher Training Program (TTP)
The teacher shall have a training period before starting to teach in the Institute. The training period will not exceed two weeks. During the training period, the teacher will be in the Institute for classroom observation. The teacher will receive briefings from the Academic Supervisor and the Institute Director, fill out the observation forms and will get acquainted with institute policies including Teacher�s guideline. During the TTP time, the teacher will receive half the rate of the regular pay.
H. Vacation
The 10~12 days of vacation will be scheduled as per the yearly academic calendar which is decided by the XXX (Corp) XXXXX Univ: The vacation will be in the form of one week in the summer and one week at the end of the year. During the vacation the teacher will be paid the basic rate of payment but no overtime will be paid according to Article 47 and 48 of Korean Labor Standard Law.
I. Completion Bonus
On completion of one�s responsibilities of the full contact period, an additional month of regular salary per one year shall be paid as completion bonus. However, if the teacher fails to complete the full period of one year contract, none of the completion bonus shall be paid according to Korea Labor Standard Law. Completion bonus will be paid by bank transfer within 45 days after the teacher has left the Institute. Korean tax will be withheld. Any outstanding debts incurred by the teacher will be subtracted from the completion bonus.
J. Covenants
The Teacher hereby agrees, covenants and undertakes that he/she will not disclose any information relating to the Teacher�s contract conditions to others, any teaching materials, or any information relating to the academic program, whether verbally or in written form, to individuals or corporate entities.

There's quite a few things, which rung alarm bells for me especially in the last one. Oh and when one director said I looked wonderful in my photo and good! I thought WTF!? Again please your advice, thoughts and words of wisdom will be really appreciated!!
