I got my criminal background check and it had the notarization. I added a post-it when I sent it in saying I needed an apostille for it. I thought the FBI took care of that.
Well, six weeks in Korea and my employer and I figured out that my background check was never apostilled. To make matters worse the background was issued 4/18/2011 and as I understand it is valid for 90 days to get the apostille meaning the 90 day period comes to an end this Sunday, 7/17/2011. I understand that it takes four weeks to get the apostille meaning that my tourist visa will expire before the State Department even gets to my CBC.
My question is, if I overnight the package to the State Department (knowing it will take four weeks before they even begin the apostille process) will they consider it void by the time they get to it or will they use the date it was received by them(before the 90 day cut-off)? Thanks. |

How does a tourist visa fit into this equation? Maybe I'm misreading your post but if you're here & working now you're in quite serious violation of the law. |

I am pretty sure Criminal record checks are valid for six months aka 180 days. It used to be 90 days but immigration clued on that some records take so long to check and get back. The site you might have check might be bad.
Consider doing a double check with immigration. Try a phone call first, if not ask in person. |

Are you working right now? If so....
You're already in big trouble if you're working on a tourist visa. Even if you DO get the apostille + CBC, you're going to have to explain to immigration WHAT, WHEN, and with WHOM you were doing your non-work related business with in Korea on a tourist visa. As in, providing dates, phone numbers, and names, none of which you have since you've been working
I had to, and immigration does this to people that came here on a tourist visa and then got jobs.
Good luck weaseling your way out of that one. |

And he is trying to get a "criminal" background check finalized,
Reminds me of college when you apply for a loan, but the college requires you to pay for tuition upfront before the registration deadline. You get "reimbursed" a loan. Well, if you really needed it, you wouldn't have had the money to begin with  |
