Question about expiring CBC and E2 visa

Okay, so I got my Criminal Background Check back from the FBI back in April of this year, I had it apostilled and it is good to go.

Long story short, had some personal issues, got delayed, and now I am looking for a job again in Korea for this fall.

My CBC expires in October. So here is my question: Even though my CBC expires in October, if I were to get a job now, sign a contract, and apply for the E2 Visa, could I start work in November or December with this CBC? or do I need to get a new one?

I feel like the answer is going to be that I need to get another one, but it is such a hassle to get a new one I thought I might as well ask. Do I need the CBC to be current when I enter Korea? or just when I get the Visa? and if it is when I get the visa then if I were to sign a contract and apply for my visa now wouldn't this CBC work?

It MUST be 6 months old or less when it lands on the desk at Korean Immigration along with the visa confirmation number application (by your employer).

6 months + 1 day = try again with new docs.

Thank you for your reply. So when arriving in Korea it has to be 6 months old or less? Is it possible to apply for the E2 Visa now if I find a job? and get the Visa before the CBC expires even though I won't be coming until after?

Not quite correct.

When your APPLICATION for the visa confirmation number lands on the desk at K-immi it must be 6 months or less. That is the ONLY issue with the expiry of your CBC. It is not relevant to your actual visa application, your entry into Korea or the beginning of employment.

You can, depending on your employer take up to 90 days AFTER the confirmation number is issued to get a visa which then has an additional 90 days of validity before you have to enter or lose it.

In theory, you can take up to 6 months AFTER it is approved before you actually land in Korea.

In practical terms, you usually have to be in Korea within a week or so of the issuance of the confirmation number (your average Korean employer doesn't have the foresight to recruit 6 months in advance).

Nope-- you don't need a new CBC if you are staying at your current job AS LONG AS you haven't been out of the country for more than 3 months.

I'll qualify that statement.

You MAY need one.

If you have supplied an apostilled CBC (even if not FBI) AND have not been told to get a new one you CAN renew without a new one (and if they do want a new one they will tell you).

IF you have NOT supplied an apostilled CBC of some form (grandfathered in with an unapostilled CBC) you will not be allowed to extend without a new "national" CBC with apostille.

IF you have previously been warned that you need one you will not be allowed to change your status (renew, extend or transfer) without it.

How would I know if I need a new one? Should I go to the immi and ask now? I transfered jobs in March and changed visa sponsors without getting a new one. I don't want to assume anything. (especially if I'm wrong)

IF you had a change of status in 2011 AND you have not supplied an apostilled national CBC (FBI with apostille if you are American) then YES, you DO need one to extend/renew or transfer.

And to answer your question, yes, you can GO to immigration and ASK for your specifics if you want to be sure (get the name of the person you ask and don't trust the help line for this).

Thanks for the info. I've seen alot of talk about CBC/FBI checks and procedures on this site. Is there a reliable thread that has accurate information that somebody can recommend? I guess what I need is a checklist of sorts to get all this accomplished from Korea. Thanks.

I didn't have a change in status in 2011, but when I renewed in 2010 I had to sign a paper saying that I'd get the apostilled diploma in within that contract - didn't mention anything about the CBC then, but since I already had one change of status during the grace period will I have to submit the CBC?

I have it but I'm a bit worried since it'll expire at the end of the month - and yes I'll go down to immigration myself to get answers in person, but I can't until next week.

So what you are saying is that it is possible for me to use this CBC for a job in December even though it expires in October, as long as it lands on Korean Immigration's Desk before the expiration date?

So what should my next move be? Right now I am looking for a job. I remember when I found a job last May, the recruiter sent me the contract via email, I talked with the current foreign teacher's and the owner of the school, and would have taken it if other issues in my life hadn't arisen. So here I am now, should I go about the same process in terms of getting a job for December with this CBC?

I guess basically what I am saying is how fast do I need to go about this in terms of my CBC expiring in October? I am hoping to find a job within the next week, but what is my timeline looking like in terms of K-Immigration getting my CBC on their desk before October?

Which date on the CBC would immigration use to determine the expiration date? I have a CBC that was received by the FBI on 2/25, returned on 3/10, and dated 3/16 on the very top of the paper. So will it expire on 9/16 or earlier?
