hi there. i finished on july 4th and still haven't received my severance. the school told me that it's up to GEPIK to disburse the money. i contacted my coordinator and she told me i should contact the school. when i mentioned that i had, she stopped contacting me.

so two questions:

1) how long has it taken you to receive your severance payments?
2) what should i do if non payment persists?

It's the employer's job to pay. Just like they did all year. Times up. Contact the Ministry of Labor office for your district. They will take your complaint, quickly schedule a meeting to hear from the employer and you (bring your contract), give the employer 2 weeks to cough up the dough.

After my hearing, I asked if I should get a piece of paper saying that they had decided in my favor. They said no. I said what would happen if the employer didn't pay up by then. The M. of L. guy held his 2 wrists together. I understood. And the employer paid up before the 2 weeks was up.

That was my experience with them last month. Very good.

By law they have 14 days (starting the day after your contract is up) to give you your severance. My boss wanted to give me my severance two months after I finished, so I went to the Labor Board. Problem solved.

Me: What happens if they don't pay?
Labor Board: Don't worry. They will.
Me: Really? How can I know for sure?
Labor Board: Because if they don't, they'll be arrested.
Me: Oh. Cool.

It comes from the employer (the school) and they are required BY LAW to pay it out within 14 days of the termination of your employment.

Time to file a complaint with the labor office.

So you mean GEPIK teachers must leave within 10 days if they want their flight money which means they cant stick around long enough to make sure they aren't screwed out of severance?

Usually this isn't a problem with public schools. Now that GEPIK is going through some changes, we might be seeing some unpleasant things.

Talk with your school to try to get severance before you leave. Then, go to the pension office and show them the flight out so you can get that money as well.

I have a similar situation. I started working at my present hagwon in June 2010. I completed my one year in June 2011. I renewed for 3 more months. I haven't received my severance pay yet. Furthermore, all the staff's monthly pay has been late every month. It has gotten really bad this month as the owner has not paid us in almost a whole month. The school is not financially well. We have had a lot of students drop out. I have one month left until I finish at the end of September. I am worried I am not going to get my severance at the end along with the last months payment.

Any advice on what I should do? Does the hagwon owner have to pay me the severance now even though I am still working for him as I renewed for three more months? I'm thinking of calling the Labour Board and filling a complaint.

At this stage, I would say no. I think you should have negotiated this before you agreed to teach more. This goes with anything which includes more work.

No, he doesn't have to pay it out yet BUT they can act on your late pay (provided it is more than 14 days late).

Filing a complaint WILL complicate your end of job (the employer can still screw with your pay, severance and flight home) unless you are prepared to stay and fight it out.

What do you suggest I do then at this point? I have exactly one month left until my contract expires. I thought by taking action now I could have it all dealt with by the time I leave. Contacting the labour board it would serve as a warning to him. What would you do in my situation ttompatz?

PS. I was planning on leaving Korea for good at the end of my contract in September to begin a long backpacking trip around Asia before heading back to Canada for good. I wasn't planning on staying and/or returning to Korea. I do have a Korean friend though who could help me out with any legal work that has to be done after I leave though.
