MATESOL and Korean experience means you should be able to land a uni job on an E1 (the CBC is not an issue).
IF they are trying for a NEW E2 you can pretty much, in the current climate, rule out a visa confirmation approval (unless you or your employer have friends at the local Kimmi office).
IF it gets past the desk at Kimmi then you are good to go (till the rules change again).

Not true.
Because of the federal system in the United States, the FBI doesn't actually go out and find the stuff - it must be submitted by the local jurisdictions, be they city, county, or state. As such, it depends on your jurisdiction. Some jurisdictions won't submit anything lower than a first/second grade felony while others will submit everything.
At the same time, some places have the man power/courtesy to take the time and remove things like this - others don't. If I were you, I'd go to the county attorney/states attorney with the FBI check in hand and any supporting paperwork and tell them "hey, you guys are screwing me out of a job here" and have them submit the paperwork to remove it from the check. IF the situation is as you say it is (and you're more polite than my terse suggestion) then they'll probably be able to help you. If you have an attorney, talk to him and he can probably get it done quickly.
All hope is not lost, especially since this isn't an expungement but an error. |

Well, if the uni asked for my CBC, then they must be doing an E-2, so I've got a 50/50 chance since they're not doing an E-1 apparently.
They haven't told me what kind of visa. I am going to send with my CBC a photocopy of my old ARC card and explanation of the CBC in brief.
Do you think that would help? |
