My current contract ends October 1st. I will have to drop by immigration in any case to extend my ARC because that expires a few days before. I hope to extend that for a month because I'd like to stick around Korea and find new work.
I also have a CBC that will expire on September 16th. As I understand it, 2011 is a grace period for needing new documents for a new visa and you can do one "change of status" without the E-2 documents. So the extension would count as the first; transferring to a new employer on the same visa would count as the second.
Question is: can I use the CBC for the FIRST change of status (extension) even though it isn't strictly necessary, and will that CBC still be valid for the transfer (ie I won't have to get a new one?) |

As far as I am aware, most things are possible as long as you are in Korea and you do things in advance. maybe an expert here can give better advice.

There is not enough background for an accurate answer so you get a couple of if-then's.
IF you have an apostilled, NATIONAL (for Americans this means FBI) background check then you use it before it expires and it remains on file for the duration of your sojourn (extensions/transfers/etc).
For MOST other E2 holders the CBC they used when they received their most recent visa already was in compliance so they have nothing to worry about.
The same is true of your apostilled degree (photo)copy. They want one on file (applicable for those who used an original rather than a copy when they got their most recent visa).

For a bit of extra background: I've been here since October 2009, and all of that time has been at the same school. I'm also an American citizen so I'll have to get a new background check in sooner or later anyway.
So basically if I submit it now, I can do both an extension and transfer and won't have to get a new one until the E-2 expires completely? Sounds like a relief, since that would give me a bit of extra time to find new work. Thanks for the quick response. |

I just dropped by immigration and the clerk said that I could submit the CBC now and as long as I don't leave Korea for more than 3 months I won't need a new CBC. She also mentioned something about a D10 visa for people who are looking for work, so I'm not sure if those three months count if I leave and come back on a tourist visa? Anyway, this gives me a bit of extra time to find new work so I'm glad. |
