|

One devoted White Castle customer is suing the restaurant chain because he can't fit into the restaurant's booths. Martin Kessman, who weighs 290 pounds, complained to management for more than two years after repeatedly knocking his knee into the tables' metal supports.
After the 64-year-old New York stockbroker sent a series of letters of complaint to the chain, he received what he called condescending responses. White Castle sent him free hamburger coupons and promised that it would expand its booth sizes. But the booths were never changed and Kessman is now taking his case to federal court.
He is suing for bigger chairs and unspecified damages because he says the eatery is violating the Americans with Disabilities Act. (He compares himself to pregnant women and the handicapped.) The lawsuit, however, has not put an end to Kessman's love of mini burgers. Now, instead of going to White Castle himself, he sends his wife. |

His weight is something he brings on himself, so why should he get damages? This is obviously frivolous and one of the serious problems with the USA. If anything there should be a sin tax on anything associated with excessive eating. |

Let me ask you something. If the judge grants White Castle summary judgment (and dismisses the suit), will you admit that there's a possibility frivolous lawsuits aren't the huge threat Americans have been indoctrinated to believe they are?
Also, madoka, link? |

"Frivolous lawsuit abuse costs consumers billions annually and replaces common sense."
Lawsuit abuse is rampant, one parent who recently sued a school district over an injury her child sustained at a school swing set, forced the school district to remove all swings from all schools in the district.
The US Chamber of Commerce reviewed all state laws to see which states had the best and worst laws fostering lawsuit abuse. California ranked 48 out of 50. So its not surprising that the Walmart case was certified as a class-action by the 9th Circuit Court of Appeals in San Francisco."
http://biggovernment.com/asparks/2011/03/29/walmart-gets-punked-by-frivolous-lawsuit/
on the other side:
Walmart: Too Big To Sue
But as it decreed that the Walmart employees were not entitled to be treated as one class -- because they worked in so many different places under myriad bosses -- the Supreme Court effectively reinforced the advantages of corporate scale, said legal experts.
basically what the Supreme Court did was say "hey, you individuals can go up against Wal Mart as an individual against the might of Wal-Marts corporate lawyers. Basically, an almost impossible tremendously difficult battle if someone were to choose to even try.
Frivolous lawsuits is the one of the last issues that is topping Americas current problems:
Education - years of neglect for Teacher salary or incentive to keep teachers even w/being unionized. Statistics consistently showing other countries outperforming in Math and Science
Outsourcing - been going on for years and until Made in USA makes a comeback in a big way, cheap labor + cheaper materials overseas will continue to cause the current tremendous job loss...also, someone put it best, "Americans feel that certain jobs they just won't do or are beneath them i.e. working the fields w/exception of farmers"
Corporate Greed & Government woes - too many to name but yeah, lawsuits are probably not as important when compared to the former |

To my knowledge, he could roll his fat rear up to White Castle in his car, as most of them have a drive-thru.
This sounds like a case for Judge Judy. |

On a more serious topic: are the White Castle burgers any good? I have never tried them myself (never even heard about White Castle before this thread), so I wonder how they compare with Burger King/McD/Wendy's burgers. |

Does 290 lbs. qualify? I remember Homer had to get up to 300 to be considered disabled. |

Have the other burger chains increased the sizes of their booths? If White Castle has smaller than 'normal' booths, I guess they should get with the times...? Maybe their burgers aren't very good, if they haven't increased their seating capacity for the... handicapped and pregnant.
Funny story, anyway. |

Hopefully, the fat ass will die of a heart attack before it goes to trial! He deserves to have one, what kind of lowlife would make a career out of eating there? BTW, Rat Castle burgers SUCK unless you are very drunk or stoned and it is 3 am and everywhere else is closed! |

As OHIO says, no, they suck. There is no reason to get one unless you're a) super broke b) nothing else is open and you're in dire need of food. |

They are pretty tasty, but they really qualify more as a junk food snack than an actual meal. They're pretty flimsy in what they are composed of. |
