Dual citizenship????

Hey guys I have a quick question and I've checked online but all the sources are a bit vague.

My girlfriend is Korean, she has Korean citizenship. But she was born in France and lived there for the first five years of her life because her father was pursuing a PHD in France. However, both her parents are Korean citizens. I heard that recently Korea allowed dual citizenship, so I was wondering if it is possible for her to claim her French citizenship since France has birthright citizenship! Thanks everyone!

She doesn't qualify if both of her parents are Korean citizens.

The new law only applies to a few specific circumstances. (One Korean parent and one foreign parent)

I have limited knowledge of the subject but I know that Korean adoptees can get dual citizenship as well as highly skilled foreign passport holders. I haven't heard about the one foreign parent requirement but yes, the dual citizenship is hard to get.

The law that went into effect January first this year allow dual citizenship for the following people.

1. Foreign nationals married to a Korean citizen
2. Children with one Korean and one foreign parent
3. Foreigners over 65 years of age who wish to retire in Korea
4. Foreigners who have made major contributions to Korean society (determined by the Ministry of Justice)

They're making it easier for foreigners to acquire Korean citizenship, they are not making it easier for Koreans to take on a foreign citizenship.

Korea has no say in whether or not she can claim her birthright French citizenship.

France does not require her to renounce her Korean citizenship for claimed birthright citizenship. She would have to renounce to become naturalized. but that is not the case.

Short answer is yes, she can claim her French citizenship and get her French passport in addition to her already being Korean and holding a Korean passport.

Those are in relation to a foreign national claiming or naturalizing as a Korean citizen, NOT a Korean national claiming a foreign (birthright) citizenship abroad.

I don't think she'd get it since she left when she was 5


Children born in France (including overseas territories) to at least one parent who is also born in France automatically acquire French citizenship at birth (double jus soli).

A child born in France to foreign parents may acquire French citizenship:
at birth, if stateless.
at 18, if resident in France with at least 5 years' residence since age 11.
at 16 upon request by the child and if resident in France.
at 13 upon request by the child's parents and if resident in France.
