So I am filling out my SMOE/EPIK application and one of the questions is "have you ever broken a contract?", and I am unsure of how to answer it
Here's the situation: My first private academy that I worked at in 2009 cancelled my contract short because they were unable to pay me my salary, so my contract was broken, but through no fault of my own. My recruiter says that I should write a letter describing the situation. I have completed another contract with a different employer since then (2010-2011). Any thoughts and ideas are appreciated. |

There is space to explain on the application. I said yes, and explained that I had to drop out before even getting my NOA... I'm not even sure if that's considered breaking a contract. |

My recruiter already knows about it, they have a digital copy of my application with a yes checked (which is what they told me to do), and it is evident on my application that I wasnt here for a full twelve months my first tour in Korea. What can/should I do now? I dont want lose out on SMOE for something my employer did to me almost 2 years ago. |

I finished my last contract early (i was recruited in october so in order to maximise my chances of changing jobs i had to finish before the next term started).
If asked i would say No.
And the reason is this: i fulfilled the duties of the contract through providing my 30 day notice. Indeed i gave them 2 months. And since this is a clause in my contract for release, i therefore adhered to the terms of contract  |

Agree with poster above. Breaking a contract would be doing a midnight run (leaving without notice). Leaving and giving the required notice is simply ending the contract within the terms of the contract....that's not breaking the contract! |

Exactly. You do not "break" a contract when you end the contract according to the terms spelled out therein. |
