Just read the 11 page sticky up above and I'm even more confused.

I am from California and I need an FBI CBC to extend my visa, which expires in January, 2012. Was told by immigration this morning that the laws have changed and I will need the FBI check to extend my visa.

Anyone know how long it will take, and/or what the best way is to get this done as quickly as possible?

Thanks.

Are you in Korea now? If so, why does it matter what state you're from? Below is a quote from pg 69 of the New E-2 guidelines sticky for doing your FBI CBC from Korea:

I'm going through this now, so I'd like to offer what I have found through phone calls to the FBI and talking to the office in my state that issues apostilles (this is for Americans). I'm renewing for the third year and I need to submit both my apostilled diploma copy and my apostilled FBI check because my visa expires after 1/1/2011.

An FBI check can be done from here, but give yourself a lot of time (like 12 weeks) and plan to spend a bit of money sending things FedEx because you want to be able to track it! http://www.fbi.gov/about-us/cjis/background-checks/background_checks has all the forms you will need. There are links on the right side of the page. Make a few copies of the Standard Fingerprint Form to take with you to get fingerprinted in case one of them gets smudged. I went to a police station here and they did the prints for free.
The above website also contains the address of where you need to send the fingerprints and application once you have completed them. It is suggested to send them FedEx or DHL so that you can track them. Also, make sure to request that the copy of your background check is authenticated by the FBI so that you can send it to the US Dept of State for an apostille. Explicity state this on the application to save yourself the delay.

Obtaining an Apostille on Your FBI Background Check
Once you have received a copy of your background check, it then needs to be forwarded to the US Department of State Office of Authentications. This is the only office that can do it- your FBI check cannot be apostilled at the state level because it is a federal document, so you must mail or hand deliver your document to the Authentications Office. The FBI will not send your background check to another federal office.

US Dept of State Authentications Office
[email protected]
phone: 202-647-5002
fax: 202-663-3636
15 day turn-around time for mailed in documents.
Fee: $8 per document- check or money order to US Dept of State. Credit cards can only be used for walk-ins.
Walk-ins: 7:30-11am M-F, 15 documents per day only.

U.S. Dept of State Authentications Office
518 23rd St NW
SA1 Columbia Plaza
Washington, DC 20520

Diploma Apostille
You need to make a photocopy of your diploma to have apostilled, as Korean immigration will not return documents submitted. This procedure will not necessarily need to be done in the state where your diploma was issued, but check with the state you plan to have it done in to make sure. The reason you can get the notarized copy in a state different from the one it was issued is that the notary is not certifying that you did the work to obtain the diploma, they are simply certifying that the copy is a true copy of the original document. You will need to have a notarized photocopy made and most states have a certification form that needs to be completed and attached by the notary. Once you have the notarized copy, then take it to the appropriate office for the apostille.
Heres a link that has the location of the offices for each state that provide apostilles.

They were asking about the FBI CBC, not the diploma.

I am also from Cali, and in Korea. It really depends. I got all my documents in 6 weeks because I contacted my local congressman. However, I lost my last job because I couldn't get my docs in time, and am having a difficult time finding a job.
Thanks for the Winedu info. I had an interview with them the other day.

I know exactly how to do this so I have provided instructions. My former company, 1345, and this website were terrible for figuring this whole process out. I agree all it does is confuse you more, and I only learned by doing.

If your congressman is up to it 6 weeks, if he doesn't care your are looking at 10-12 weeks. Also keep in mind that you can use usauthentication.com to apostille your docs in 3 days. However, I must warn you they are terrible about answering emails. They got the job done though.

Here is the fastest way to do it. I know this because I just went through the whole process.

1. Go to your local district police office the main one of the gu
I.E
If you live in Gangnam, the main police station of Gangnam.
Have your fingerprints taken there.
Print a couple of copies.
I did 3 just in case the FBI rejected a set. (Read the horror stories)
you do not need to fill out the ori section, which everyone asked about
Send it to the FBI CJIS in WV
and make sure to include a separate note stating

"Please provide an FBI seal and signature from a Division Officer for the purpose of obtaining a Federal Apostille."

http://www.fbi.gov/about-us/cjis/background-checks/background_checks

2.
If you dont already have one, open a FedEx account. If you dont, you have to go to FEDEX headquarters, which is by Kyungwon University Station
exit 4.
Walk about 5 minutes and you will see it on your right.

Have a Korean go with you, or have it written on paper that you want to open a FedEx account.

When I went there an Adjossi appeared out of nowhere and happened to speak perfect English. I was fortunate that he was there because he explained to them what I needed. He told me even though he doesn't work there, he goes there everyday. WTF? If you go there, you will probably meet him. He was very helpful, and it was almost like he was a guardian angel or something.

3. Send your diploma to http://www.usauthentication.com/
or apostillepros.com to get it apostilled. Usauth is much cheaper. They will respond to emails about inquiries, but are terrible about responding after that. Once you have your FedEx account go to your local FedEx kinkos and make sure that you include a prepaid envelope when you send out your diploma.

4. Find out who your local congressman is in Cali, and get his email. Send him an email saying you would appreciate his help in expediting an fbi cbc to Korea. If he is cool about it, he will send you a form to fill out, which you simply fill out, scan, and send back to him. In my case it was one of the congressman's assistants who helped me through this.

5, Depending on the time of season, and whether or not your congressman is helpful or not, it will take 6-12 weeks.
When you get your FBI CBC back, and find out you have no arrest record
you will have to send it back to the US. Make sure to enclose a prepaid envelope again. I used usauthentication.com to get the fbi cbc apostilled. It should take 3 days.

6. Once you have both your apotilled degree, and apostilled fbi cbc in hand, visit Kimmi.

Thanks for simplifying that, I really appreciate it.
Seems like an insane amount of work just to extend my contract a couple of months. Incredible pain in the a**!

I agree. It is ridiculous, and it will end up costing you at least 200 bucks. I am glad I got it over with, but the inability of anyone to explain things clearly, including 1345, was incredibly frustrating.
Good luck
