Never even realized this is an issue at some schools. All the schools I've been at it doesn't really matter. Although I actually do like school lunches, but am free to do errands whenever, as long as I don't miss my assigned class. |

You'll probably find the schools that are so anal retentive about lunch hour are the same schools that make their teachers stay ALL DAY everyday during winter and summer vacations. |

yep, already got screwed the first week of sept. before classes. Got to start preparing the lube for winter break so it doesn't hurt so much. |

To be fair, staying at school during vacation time when you don't have camp or personal vacation time is part of your contract. So expect it. Just pray that your principal finds a heart and lets you leave after camp. You could always try asking who ever is the admin that day. Tell them all your plans are done and ready for the next day.
The good news is that no one will be there checking on you. So feel free to do what you want. Watch movies, do P90X, whatever. |

Notice is 54.1 it says - an employer shall allow. To me, this means that the choosing of when the employee is allowed to use his time for recess is determined by the employer. Provided that he follows the rules stated.
Then in 54.2, it may be freely used by workers. Meaning once he is given his recess period, the employee is free to do what he wants. (go to the bank, grab a coffee, have a big mac...)
So it is up to the employer to decide when the recess is. Not the employee. The employee can choose what to do and where to go during it.
So if your school has more than 10 employees:
Rules of Employment
Article 93 (Preparation and Filing of Rules of Employment)
An employer ordinarily employing ten workers or more
shall prepare the rules of employment concerning matters
described in any of the following subparagraphs and file it with
the Minister of Employment and Labor. If any amendments to
the rules of employment occurs, the same procedures shall also
be followed: <Amended by Act No. 10339, Jun. 4, 2010>
1. matters pertaining to the starting and finishing time of
work, recess hours, holidays, leaves and shifts;
(This also shows that it is up to the employer to decide when recess is)
If you are free to use your recess whenever you want, do you think you would be allowed to take your recess during the middle of class? |
Obviously not...since recess is clearly at lunch time. Of course the employer could change that...but he has to give at least a 30 minute break in the day somewhere there.
And it's not just me...I see some Korean teachers going out at lunch time and always a fair number of the students. |

If that's what your school decides then yes it is at lunch. If your school wants you to stay during the time lunch is served, then you should stay. If your school lets the employees decide on their own then that is their choice. As long as they comply with the LSA, it's the schools decision.
So we agree then. Th OPs boss is power tripping and being unreasonable. But he has the right to decide when recess is. So the OP is kind of screwed there, provided the boss lets him have at least 30 minutes break.
And like I've said, it is going to be hit or miss depending on the school. My school (like most schools) let me leave quite often to run errands, go to the doctor with my wife during her pregnancy, and even go on interviews during the end of my GEPIK contract.
But from what I've read on this board and on waygook.org, quite a few schools are on lock down and are really anal about signing in and out and getting approval to leave. So I think that when informing new teachers about ducking out of work for a few minutes, it would be in everyone's best interest to tell them its best to know what your school's individual policy is regarding leaving the place of employment during work hours. And to try to work within that framework if possible. But if your school is being unreasonable jerks (and violating the LSA) you can tell them that you are legally allowed to leave for 30 minutes during the day.
Here's some threads from waygook (which were easier to find because their search function actually works). The first one is my favorite, this guy isn't even allowed to walk around the school. That is ridiculous.
