So...

Have been in korea for past 6 years.

For my last 3 jobs I have just transfered over my visa and immi has let me do so without renewing my docs as; my last crc in 2008 was nationwide (uk); my diploma was notarised by the Korean consulate in London way back in 2003 AND the British council in Seoul; as were my last set of transcripts.

So for my last job I wanted to find out why I was getting this new sort of special treatment. I was told that as of Jan 2010, if you have been in SK on an e2 for over 5 years and haven't left the country for more than 3 months in that time - you don;t need to renew your docs anymore (provided that your last crc was nationwide of course.)

Okay, so, no problemo there.

BUT HERE IS MY QUESTION - I transfered my visa two weeks ago to start my new job after having completed my year long contract at my last job.

I got fired from my new job today. I would like to get a new job lined up, of course.

Do I need an LOR? Will I be able to transfer my visa to a new job seeing as I was fired and we will be effctively, I guess, cancelling my visa.
Oh also - no notice. As of tommorow I have been asked to not go in again. I'm cool with that and would prefer no notice period anyway. but when should we cancel my visa and how? Will Immi then give me an extension to stay and job search?

Will I have to leave the country? Get new docs...?

Advice very much appreciated here as this has never happned to me before, I have always transfered and completed contracts so this is a new ball game for me, being fired after 2 weeeks!

Also anything else I have overlooked, please let me know.

NB - Please only advice from experienced posters. No 'maybes,' or 'I heards...'

Sorry, but you are going to get some maybes.

IF your visa gets canceled OR you can get a LOR you MAY be able to transfer without new documents.

It really will depend on the guy at the desk when you go in to transfer.

IN THEORY you have used up your "free pass" for 2011 but your documents were "national" and properly attested.

So therein lies your maybe.

Your documents, even though properly attested did NOT have an apostille and under the current rules, ALL E2 teachers must have them on file or, if they have been here for a while, were allowed 1 grandfather transfer without and you have had it.

IF you do not get a LOR then you will need to get your current visa canceled and then you WILL need new documents that meet the current requirements.

They may allow a transfer, they may not.

There is no hard answer for you.

All of my documents, are in fact appostilled by the required agencies, including my CRC and they are all on my immi file, on their computer.

IF they in fact have an apostille then you are good for 10 years. Get your LOR and find a new job.

If they were notarized and certified by different agencies as compared to actually having an apostille from the FCO then MAYBE is your immediate future.

Yes they are apostilled.

Anyway a new development. She sent me this email. Should I follow her up on the offer to delay the visa cancellation? Would that set me up for any problems (maybe if she in reality cancelled it and then left me overstaying and set up for a fine or deportation and blcklisting?) Do I even need to do that or will immi let me stay to job search if we cancel it tomorrow? Man I hate the situation here in SK where it's hard to tell what to do or if you're being ripped off or set up for some undoing or not. She certainly seems genuine in the email though.

I searched the way you can cancel our contract.

I wonder if you stay and look for another academy or want to go back your homeland.

If you look for another academy, to give you more time to look for it I can delay the day to sumit paper of canceling our contract until October 25th.

And if you don't find a proper working palce, before the 25th you can get trip visa and after the 25th you can continue searching academies staying here

On the otehr hand, if you want to go back you homeland, i can immediately sumit a paper of canceling for you.

Which one do you want?

And for your salary I can give it until next Monday or Tuesday.

From recruiter, i heard you can move until this week.

If you move out of the apt, i can count your electric fee, gas fee and your maintenance of apt.

So i am ging to pay your salary until Monday taking away your fee.

If you choose your plan, give me an answer by emailing.


Any advice based on the email?

I sent one back saying if it's okay I'll stay here in the apt until next wed then (wait until see the 2 weeks salary before leaving seems sensible) and yes, I'd like to stay in Korea to get a new job, so if it's okay with the immi office, let's delay cancelling the visa.

Any thoughts? I could just go stay at a friend's and cancel the visa asap, but am not sure if immi will let me stay in country without a job lined up, even though all my documents are apostilled and sorted though and they usually seem reasonable and let me do that once, but that was a few years back.

I have been in Korea over 6 years and for my present job I had to submit the CRC and Diploma with all the new requirerments. I didnt hear anything about the 5 year exemption period. Also, this is first time I have heard that our documents will be good for 10 years. Thats good news to me!

Yea I think there is some laxing on the paperwork a little BUT my advice is

    Have extras - You never know when something gets lost or used.
    Keep an eye out on the forums and government websites about changes.
    Treat criminal record checks like toothbrushes and password get a new one every six months.
    Take any changes with skepticism. It takes time for the whole system to catch up and even them some officials still do not know the rules.

If your school will not provide a letter or release (I don't know why they wouldn't) go to immigration and tell them they won't give you a LOR. As far as the documents goes, it's immigration that needs the documents, and it's only been two weeks so immigration should still have all your necessary documents and getting a work permit should not be a problem. I know for a fact your apostilled diploma is kept on file and you don't have to show immigration another one. They probably keep your CBC on file too and as long as its current there won't be a problem. Anyway go check with immigration as soon as possible because whether or not your allowed to work is up to them.
