My school, sorry hagwon, is closing in November. The owner of my hagwon owns another hagwon, but they are under different franchise names. My school is closing and the students are going to the other school that he owns. Incidentally, I have never met him as he is not the principal/director/boss of my school.
My contract was to finish in December. When the school closes, it will be less than 1 month till the end of my contract date. What can I legally do about:
1) severance
2) my paid flight home (indicated in my contract)
3) "security deposit" - this was deducted from my first three paychecks
4) outstanding vacation days

I went to the Labour Board without much success. The one man there told me that I am without any rights to any of 1-4. Can any one offer me any insights, legal advice, places where I can get legal advice.....

Also, I have not been given any information in writing by the school about any of this.

They gave you wrong advice, I suggest you try to talk to someone else at the labor board.

You need to have been working there for a year to be entitled to your severance.

2,3 and 4 you are entitled to. Speak to somebody else at Labour, don't take no for an answer!!

Is the school not to going to try and transfer you to the new school? I mean it could be done with a visit to the immigration office. Yea it might make life difficult for a few month. I can not see why they would not try that.

So, if I'm understanding this.....
For any teacher who loses their job in the 11th month, the hagwon gets out of paying a severance?

Pretty much - yep. That is why 11 month firings are common.

It's still worth fighting. It's in the 11th month. You could make a case for the flight home and severance.

This is what I would do. If the school refuses to give any money beyond your salary (forget the vacation days, you'll be getting more than you need after November Laughing), tell them you want 11/12 salary (for severance) and a release letter to go to another school. If they refuse that, then ask again and let them know you will go to the Labor Board and fight for both a flight home and severance as it is an 11th month firing (that's 12/12 100% severance and flight home).
