Hi.
I'm in a public school in SMOE.
A guy who is in a public school in Gangwon province told me that if he takes a week's vacation where one of the days is a public holiday, that he gets deducted the full 5 days and not 4. i.e. the public holiday is still deducted from his annual leave entitlement.
Does the same apply in SMOE?
I hope not. My contract says that I get 21 days so I had better get 21 days off! |

If you take a week off and Monday is a public holiday, you should only have 4 days deducted from your vacation time. The fact that you get public holidays off is stipulated in your contract. This example is exactly what I did over the summer. I am also with SMOE. |

Yes, in no way should public holiday ever count as vacation for anyone. Sounds like your friend's school doesn't know the law. |

Which holiday is this? Sometimes schools have a day off, and it is not a contract holiday. So instead of making up the class later, they are just giving them a day off (killing 2 birds with one stone).
To properly address this, we should know when and for what purpose. Different "holiday" days off can be made for various reasons. So, which holiday is it? |

Actually there is no law, and it is quite commonplace for a 'vacation week' to fall over a holiday. The korean teachers at my school get 5 days of vacation a semester. Their vacation this summer was Thursday-Friday-Saturday-Sunday-Monday, monday being a holiday. |

I've been told if you leave Korea even on a public holiday, it has to count as a vacation day but if you stay in Korea, it won't count.
Also, if you're on vacation longer than 15 days, then any public holidays that fall into that vacation period are counted as vacation as well. |

He says it's the situation in his area but he's not claiming it is the case in Seoul.
He said he was told it by his coteacher, foreign co-ordinator and county education office head. Their vacation is different in that province anyway in that they get 35 days annual leave but that includes Saturdays and Sundays.
I just want to get confirmation that it isn't the same in Seoul with regard to the public holidays thing. |

Agreed.
I am told that, despite what's written on the contract, vacation could be different from school to school. |

Read your contract.
Calendar day or Working day?
Calendar days take public holidays and regular working days. When renewing we are only given "calendar day" holidays. That means they can force us to serve holiday time during Lunar New Year- if that is your renewal time. |

Buy your principal some biscuits and give your co teacher some wine, the contract wont even exist.

they're unlikely to break it, but they can "bend it" (to your benefit) |
