Well, I just got a letter today about doing another health check and about getting copies of everything immigration has. Great.
Anyway, I sent my original degree here, and only have a state CBC (I came before the new regulations).
Will I need to get my degree apostilled and an FBI check or just give them copies of my degree and original check that immigration has. The letter said apostilled, but if it was good enough for immigration when I renewed, then it should be good enough for MOE.

Please for the love of GOD if you want to stay here longer - GET your FBI/Federal check done. Actually a piece of advice is treat your documents like your toothbrush and or password. Get new ones every six months. Likely and with luck you can get away with previous check (usually just the educaton papers). But always have them ready for that one official that decides he wants it done his way!
Yes last year immigration gave some leeway in regards to state check, but they WANT FEDERAL now! Never mind if you never left the country, the want a Federal. Never mind, if you are renewing with your same school. Come 1/1/2012 or the end of your current contract you will need a Federal check.
As to Ministry of Education I think they just want copies. Immigration will be the one asking for certified, stamped, and all gussied up papers.
Better start now as your FBI will take about two months or more to get. |

If you've ever turned in an apostilled CBC and diploma copy and it is in the possession of either immigration or your MOE, you should have an easy time getting a copy of either at the appropriate office.
I recently got a copy of my previously submitted CBC from immigration and that was good enough for my new employer who was requesting a CBC.
If you've never turned in the real deal then you should apply right away just in case. |

You managed to take advantage of the grace period (2011) for your extension. You don't get another one. The grace period was to allow you to get your documentation in order should you desire to stay.
If you plan to stay here you WILL need to produce the FBI check and degree copy with the apostille (for your next extension/transfer/change of status with immigration and for the MOE).

| Do I need to have my degree copy notarized and apostilled in the same state as my University, or can I do it from the state I am a resident of? Does it matter? |

That question can only be answered by the SoS you want it done by. It varies from state to state.
Kimi doesn't care as long as it has an apostille on it.

I realize this is tied to my other thread, but are the new documents necessary to be legal at the school you're at, or only if you're extending? Are you grandfathered in if your visa is legal, or do you need to supply the federal CBC by the MOE guidelines?
Basically, my contract finishes up at the end of February, and my visa is good until the end of March. Do I need a federal CBC by the beginning of February, or prior to the end of my current contract? I work with a few teachers who were grandfathered in and are extended through the summer of '12; do they need new federal CBCs even if they aren't extending? If they don't get the federal CBC will they be in violation of MOE guidelines? |

Honestly, I don't know and I can't find an answer to your questions in regards to your co-workers on-line or one from the ministry (personal contact) that I would state as fact.
What I do know is that IF you are on an E2 AND do not need new ones for Kimmi (not an American or have the FBI check on file) then you are also fine (just use copies of the ones from Kimmi (cost you 300 won and a trip to their office)) for the MOE and you will be in compliance.
IF you ARE American and do NOT have an FBI check on file then they MAY let you complete your contract on your current visa but won't be able to extend your employment beyond that time (kimmi and MOE).
There are other circumstances for other visas (F2/4/5, E7) who are or want to be teachers (NOT including universities on an E1) but basically the requirements for teachers (under the MOE) are the same as those needed for Kimmi on an E2.

| Okay. I'm not concerned about getting all my documents together prior to the end of my visa in April, but I'd rather not be out of compliance with the Ministry of Education if they happen to check my school's documents. My school is operated by one of the largest media companies in Korea, so they're generally very above board when it comes to legality, I'm just concerned that the guy telling me it's fine unless I want to extend doesn't know what he's talking about. So far, he's telling the F-visa holders in the office that they don't need an FBI check unless they're extending, despite end dates in April and August, well past the MOE deadline. |

| My contract expires June 1st and I will be returning home. I came here while the state level CBC was still accepted and the original degree. My contract expires in less than 6 months. Are they really going to have me stop working if I cannot get these documents? By the time I get the FBI check, I will have probably 3 months left. |

This is essentially what I want to know, and is really unclear. Considering that F-visa holders now need the documents, when would they need them if not for the official February start date? And if they need them for the February start date, so do all the E-visa holders, I'd imagine, even if you were grandfathered in last summer with a state CBC. |
