my friend just finished her ba, she has an assault charge for common assult hwen she was 18, can she apply for work in korea??? anyone else been in this position or know someone who has? thanks for any help.

I'm not entirely sure, but I've heard it's very difficult with any kind of criminal record.

I sincerely doubt it. I mean, just think about it. You have two candidates to work with children. One has an assault charge, the other doesn't. Which one would you choose? It doesn't matter what you know about her as responsible person. No-one hiring her will know any of it.

I had a friend here brought over illegally. He applied for a visa and couldn't get one because he had something on his police check. He wasn't actually charged for it (I don't know what it was, so I can't tell you) but he still couldn't get a visa. He tried for about 4 months to get it off his record and come back but he couldn't.

People have been denied due to having a DWI in their criminal report. Your friend won't get an E-2 visa to work as a teacher here.

That one will preclude her from working anywhere that requires a CBC.

Korea is off the list.
China may be possible with an out-of-state CBC.
Taiwan is off the list for legal work.
Thailand - same as China.
Vietnam is a maybe (same as China)
Japan does not require a check.

I think the person might be based in the UK and there is just one national check so no chance of an out of state one.

Common Assault isn't as bad as it sounds but would look awful on a CRC!

It is POSSIBLE, but difficult. I know of at least one person who DID get the visa, despite an assault charge on his record, but it was pretty touch and go, and he had to write a letter of explanation about the event, and needed the school to vouch for him...but he finally did get it approved.

Of course, this was a person that had done the state check in such a way that the assault hadn't shown up before, and he had been teaching in a school already for a while before he was required to get the FBI check...and they already liked him as a teacher, and so WOULD vouch for him...a renewal with the changed requirements, not a new hire....

Having the assault known from square one? Pretty unlikely to get a school to fight immigration to push the visa through...but not completely impossible....
