So today my co-teacher handed in her notice at the afterschool program that I work for. The company sucks, I don't blame her. Rather than let her serve the 4 weeks notice my boss decided in Korean style to give her until Wednesday.

There are 4 of us in total at this school, 2 NES and 2 Koreans. The owner of the company turned up today asked the other Korean teacher if she would merge all our classes and put them into 2 groups meaning they now need just one NES and one Korean teacher meaning come Wednesday I might not have a job. Is this even legal?

If they sack me what can I do? I am nearly in the 8th month of my contract.

Who can I contact for legal advice? Any advice greatly appreciated.

Happy Xmas Korea, nice one.

Cheers,

angsta::

My contract for your viewing pleasure.

You are entitled to 30 days notice or 30 days pay (labor law).

If not then you have a valid labor board claim and can get released so you can take a new job without need of a visa run.

What he means is you have the chance to, not that it will be easy. It shows labor board is 1350, I called 1345 about payment issues before though. Maybe they just redirected me to 1350.

So in summary i'm screwed and have no rights, or if I do finding anyone to help me is going to be incredibly difficult?

Gotcha, i'll give them a call. In typical Korean fashion the school may be gone by Thursday but nobody in management has actually mentioned anything to us yet. The c nts.

It sucks man, but stuff like this is the nature of the industry. It works both ways, teachers pull midnight runs and schools abruptly fire teachers or close down.

You can't until you get fired without notice.

Then you can contact them on 1350, 031-345-5000 (to find out where to go to file a complaint) or http://www.moel.go.kr/english/main.jsp to locate the office nearest to you.

The good news is that if you do get terminated and have a labor board file open because of it you can go to immigration and switch to a D10 visa (looking for work) and that gives you another 90 days for your search (without the need to get new documents) then switch back to an E2 when you find a new job (50k won per switch).

2 million for an after-school program? Good riddance of them, I say.

Hope everything works out for you. Don't do anything until you find out for sure though or give them grounds to terminate you.

I have 2 contracts, one with the school and one with the placement company hence the school contract is for only 2 million. Wierd I know.

So today the manager turned up and said "can you guess why i'm here" after initially trying to lie about the economics of the situation. She didn't even have the balls to say your fired. We've all known all week. Anyway, should anyone ever offer you a job with a company called **** ***** then I suggest you look elsewhere.

She then gave me the we're going to have to let you go bit. I said fine but you have to give me a months notice. I told her I had already talked to the Labor board in Gwancheon about the situation (I hadn't) and that was the law. I told her i'm not Korean but this is the Korean law, your call but i'll be complaining first thing tomorrow etc. No shouting, I just told her these are the facts. She said she need to call head office, I said call who you want I want a months notice or a months pay.

Anyway, she called head office. They said OK you can stay for another month. I get paid early Jan and then i'm gone. We have 2 massive classes and 3 teachers. Unsure how this is going to work but at the same time I don't care. I just want my money then i'm off. This company is run by morons.

I usually don't care about this stuff and I would have just left, but I like to see us able to choose at least. Are they willing to give you a letter of release if you need?

The point is more it's the week before Christmas, half the schools in Korea are closed so looking for work is pointless and flights out/home are stupidly expensive. If I have an enforced holiday i'm not spending it in Seoul.

It is nice to have the choice I agree. I'm going to work the rest of the month, get paid then get a release letter in early January. To be honest i'm kinda done with Korea though.

China is cheaper and hiring, but you really need to check the schools in person before signing a contract. You can get terrible living and working conditions.

I usually live and teach in Thailand. I have taught in Korea previously but I was here essentially for the money. The plan was to leave with 400,000 baht which would pay for my MA.

The reason I don't live in Korea is partly due to crap like this. And wow, these people are so rude. You can see how they have to pay over the odds for "teachers". The concept of moving thousands of miles away to live in a society more conservative then the one I grew up in is not high on my list of things to do. I don't see the attraction.

I turned down 3 public school jobs in March for this as well. Damm. My bad.

China? Yeah, hmmmm. I would rather suck it up and do a year in Saudi. At least you know it's just for the money.
