I was working at a school that went out of business after 3 months and came back to the US with a letter of release. Apple Tree is saying that I don't need a new Visa, but another recruiter says I do need a new one. Imigrations at the airport said I don't need a new one but I don't trust their English ability. Teachers I've asked have given me conflicting answers.
I'm looking for a definate answer. Do I need a new Visa? |

Were you on an E2?
Did you get your ARC?
Did you cancel your status (hand in your ARC) when you left Korea?
Have you been out of Korea for more than 90 days?

I got my ARC card.
Immigrations told me to hold on to my ARC card.
I've been out of the country for about 30 days. |

You should be able to come back to Korea, get a new job, and transfer the Visa to the new job. |

So then why are half of the recruiters saying I need a new visa, are they just that out of it or do they have some other motive? |

You cannot change your status or job from outside of the country.
You will have to return to Korea, switch to a d10 then get a job and switch again back to an E2.
IF you are lucky, since your employer closed up shop (went out of business) you may be able to go from E2 to E2 provided you are in Korea. The 30 day thing may be an issue so I suggest that you return, switch to d10 (gives you 90 days to find a job) then back to E2. Least amount of paperwork and won't require new documents.

So recruiters/employers would find it a hassel to get my visa changed? How long can I stay out of the country and still get my Visa changed.
Wouldn't it make sense to just get a new visa rather than pay for my own ticket and try to find a place to pay to stay at while I look for a new job? |

You CANNOT do anything while you are out of the country. Full stop.
You can't cancel your status.
You can't change your status.
Since your status was not canceled you can't apply for a new visa.
If you wait more than 30 days after the school closed up shop then you may be in violation of your status of sojourn (immigration only allows 30 days from the change of your employment status (loss of employment) to notify them or make a change) and may have to wait till your ARC actually expires before you can do anything.

Okay no recruiter has said anything like that nor did Korea customs. At most some of the recruiters said I would need a new Visa.
Can anyone else confirm what ttompatz is saying? |
