Letter of Release/Visa Transfer Question

Shot in the dark, but I'll ask anyway.

Is a letter of release required to transfer an E-7 visa?

What about if a full one-year contract has been completed?

E7 and not E2?

If a contract has been completed then no.

If a contract is incomplete, then USUALLY, yes (there are exceptions).

Can I butt in here?

If someone is on an E2 visa in a public school job, do they have to finish their contract to get a letter of release?

Or can you give the required 30 days notice, and get a job in a hagwon no problem?

If you finish you do not need a LOR. You can do a transfer any time in the last week of employment up to the end of your ARC.

If your contract is ending and you don't have a job lined up you can switch to a D10 (looking for work) then back to an E2 when you find a new job.

Many PS programs will NOT, as a matter of policy and often stated in the contract, offer a LOR (SMOE and EPIK being 2 specifically).

Thanks for the info, ttompatz.

Can a visa expire during the transfer process? Or does registering for a transfer "validate" it until the transfer is complete?

The transfer process at immigration takes 15 minutes and if you need an extension you do it at the same time.

Generally:

passport
ARC
new contract
application
fees (60k won for the transfer, 30k won for the visa extension)
letter of guarantee (sponsorship form)
business registration (copy).

However, I don't think this "letter of guarantee" was mentioned, and I'm not 100% sure what it is. Is there a downloadable form somewhere, or is it just a letter stating that a company wishes to hire me?

The lady on the phone also mentioned some sort of private tax certificate from my current employer. Not sure what that is, but it doesn't sound like a big deal to get.

It is a form letter that they sign and stamp stating that they accept responsibility for you as your sponsor. It was downloadable from the Korean side of the immigration website or the local office can fax a copy to your employer.

The employer's "tax certificate" that you mention would probably be the business registration.

Grr...

I think I'm about to get burned. Curious if anyone can confirm what info I was just given regarding visa transfers.

I'll give a short version of the situation. I will be completing my contract on Jan. 20th. I had initially decided to renew with the current job, but received an offer on Jan. 9 and gave my notice Jan. 10. The contract stipulates that I should give one month's notice, so I agreed to stick around. This extension has not been processed nor submitted to immigration yet.

The plan was to leave the current employer Feb. 9th and begin the new job Feb. 10. I called 1345 and the person I spoke with stated that I will need a letter of release because a new contract will be signed.

My current employer states in the contract that letters of release are not issued. I have not spoken with my supervisor yet, but if they refuse to issue a letter of release, I think trouble will be brewing. The new employer is already antsy about the start date, so waiting around to get a new visa is not the ideal option.

I feel like the only option I have if a release letter is not issued is to go to immigration on Jan. 20 (this Friday...) and get the transfer processed and break the 30-day notice clause. I was under the impression that, as long as a year had been completed regardless of extensions or renewals, that a letter of release would not be required for a visa transfer.

Also, how enforceable by the employer is the 30-day clause if the contract concludes as arranged and only a verbal agreement to extend has currently been made? Would fines or prosecution be possible?

I still can't believe you can complete a full year yet require a letter of release. Mad
