So, my supervisor agreed to give me a letter of release, but then he fired me just before the date of release. That means I need a job NOW or I have to go home straight away.
HOWEVER, there's this thing called the D-10 visa that gives you time to search for a job and then transfer back to the E-2 without a visa run. That's all I know though. Anyone have anymore information? |

Relax, there is NO panic (other than finding a place to stay).
You have 14 days MINIMUM before you need to do anything.
Within 14 days of your termination you need to go to immigration to report the change in your status.
At that time you can apply for the D10.
You need:
an application
your ARC
your passport
fees (50k won for the application and 10k for the new ARC).
LOR
It will take a couple of weeks for your new ARC to come back.
The D10 will give you up to 6 months to find a new job and switch back to an E2.
Your other option is to just find a job (within 30 days) and move on with a simple transfer of your sponsorship to the new employer.
you need:
LOR
ARC
passport
new contract
application
fees (60k won)
new employer's business registration (copy)
new employer's letter of guarantee (sponsorship form).
Takes about 30 minutes to process.

So, I'm seeing 14 days MINIMUM and 30 days MAXIMUM to transfer/change status of visa?
The immigration office in Seoul always gives such ambiguous answers.... |

Maybe processed, I don't think it will "come back". There probably isn't a place to send it to. So, I would suggest picking it up at immigration unless you know for certain where you will be. |

I have my LOR (signed). The date of release is three weeks from now.
Here's my question:
If I get fired (because I just stop coming or because he doesn't want to have to pay me, etc), and he terminates my visa/contract/whatever employers do with immigration, is my LOR still effective? Can I still apply for the D-10/transfer my visa if he fires me before the date on the LOR?
I just have a feeling that I'm gonna get sick of him screaming in my face, and I want to make sure that I can get the D-10 or transfer my visa to another school if I just stop coming to work before the date on my LOR.
Thoughts? |

Read Ttompatz's post (just a few above you in this thread).
You have 2 weeks from termination to apply for your D-10. That means, as long as your LOR is dated 2 weeks from the time you're fired/quit, you are ok.
Read his 2nd point regarding Visa transfers. |

I just applied for the D10 a couple of weeks ago. It's going to take 3 weeks. And it actually cost 60,000 won.
Man, get to that immigration office early in the morning because it's insanely busy. I got there at 9.10am and still didn't get seen until 1pm.
I have to go back to Ireland for a wedding at the end of the month, but I can return anytime I like within the 6 month time-frame without any hassles. It's great. |

is it possible to change to a D-10 while you still have an E-2?
i was given a 13 month visa last year so now i'm unemployed but still have a valid e-2 until march 28th.
can i head to immigration tomorrow and change over or do i have to wait until my visa runs out? |

Just go to immigration and apply for the change of status from E2 to D10.
side note:
If you are unemployed now you are required to report the change in your employment status to immigration (legally within 14 days) or risk a fine.

cheers for the info
regarding being unemployed - would they know i finished my contract 3 weeks ago? i'd rather not be fined so can't i just tell them that i finished work yesterday? |

can he screw up a transfer = YES.
Can he prevent a new visa application (with visa runS) = no.
