Hi

I was reading paperwork sent to me about a job that says I should provide a "certificate of residence" in order to get the tax rebate on the salary offered. I have U.K nationality but have lived in New Zealand for last couple of yrs. I have a NZ Returning Residents visa stamped inside my U,K passport and on one of the pages it says RESIDENCE PERMIT ...Holder may remain indefinitely." Do I just show that to the employer? (My agency guy says because I am a UK national I probably need a UK certificate-but I no longer live there! )

UK residence cert to go with your UK passport = no income/withholding taxes (provided you are at a public school or university) for the first 2 years of employment in Korea.

No cert means you pay taxes (on a salary of about 2.2 million it is about 1.7% of your salary)..

Hi ttompatz

So you are saying you do need a certificate of residence from the U.K and it has to show no income for last few years even though I have not been a resident in UK for 8 yrs and my wife is a NZ citizen?

Which U.K govt office do you have to get that from-Inland Revenue ?

If an NZ resident s visa inside the passport is not enough wpuld it not make more sense to have a statement from the NZ tax dept saying I had paid tax in NZ for last few years and lived HERE?

It is not about tax, it is about tax treaties.

Get it (the one that matches your citizenship), change your passport (get a NZ one) or pay the 1.7% tax rate. Pick one.

You're the only guy who seems to know which bit of paper I need!
So-to clarify- I write to (who?- Inland Revenue in U.K or British Embassy in NZ?) and ask for a "certificate of residence" showing that I have not paid any taxes there in last period of years and have not lived there for that time either?

It really doesn't make sense >the contract says I need to ppovide 1)a "certificate of residency from the Employee's resident country 2) an "application for tax exemption" on a non-resident's Korean source of income provided under the Korean Tax Treaty"

Usually on forms they ask for country of nationality and then country of residence. So any further clarification gratefully received

Certificate of residency from the UK (considered by the NTS to be your "resident country" since you are traveling on a UK passport).

Application (from the Korean National Tax Service) for tax exemption under the tax treaty.

Do be aware that obtaining said "residence certificate" from the UK may complicate and obligate you for "unpaid taxes on foreign earned revenue" in the UK. It may well be easier (and less costly in the long run) to pay the 50k won per month in income tax in Korea. (I am not that conversant with UK tax law).

You may also try to use a certificate of residence from NZ (I imagine the tax office would be the ones to issue it ) but may end up having it refused in Korea because of your UK passport. (western logic does not apply)

Sorry to jump on someone else's thread, but you seem to know your stuff on this.

I was wondering about the 'rebate' - I paid tax for a few months before I got my residency certification, does this mean I can now claim back the tax that I already paid?

At the end of the tax year you should get a refund for taxes remitted to the NTS prior to your exemption going through.
