Pay for Time Off Due to Medical Reasons?

Hello all,

I am an English Teacher at a private Kindergarten in Gyunggi-do, about halfway through my 1 year contract.

I need to have knee surgery done next month, which will require me to take 1 to 1.5 weeks off from work. I have obtained a letter from the doctor stating the it is a necessary procedure.

My contract does not cover this sort of situation. The only "missed work" scenario that it covers involves absences without prior notice.

Will I be entitled to receive pay for the time I must take off? If it makes a difference, the first time the injury surfaced was during work about 6 weeks ago, at which point I had to be brought to the hospital.

You'll need to carefully read your contract, but I highly doubt you'll get paid... they might even threaten to fire you (worst case), or make you pay for an interim teacher to take your place during that time. They *might* let you use your sick days/ holidays for this, but seeing as most schools take off as a whole and those are you days off, this is unlikely...

Thanks for the response.

Yes, I carefully read my contract. It wasn't covered, so that's why I posted here.

I don't actually get sick days at this job, to be honest, and my holidays are pre-set with the rest of the school.

You don't even have sick days written into your contract? O.O I always had them in my contract and then was given the finger when I tried to use them... I literally had my coworkers come knocking on my door and asking why I was late to work after I called in sick with the appropriate time given and doctors medications and visit slips... smh... they're a rare thing to actually be granted, but to not have them at all in the contract is... not good.

check the labor law or tomplatz but if I recall you are entitled to a minimum amount of sick days which is more than what most contracts say

I did have to take a couple of weeks off from my hagwon job once to recover from surgery. I had three paid sick days in my contract, which is pretty standard for private academies, the remaining 7 days were unpaid leave. My employer did let me know what a huge inconvenience this was to him, and that I could just go get surgery in my home country and not come back. I chose to stay and finish my contract, get my severance and my airfare. Not a big loss really.

@Balio.

That's what sick days are for. There's a reason your hagwon excluded them from the contract, they don't want you taking time off. You can always ask your boss, but my bet is on the boss giving you unpaid leave and making a very big deal about it.

You are not. Labor law provides for no paid sick leave. It is strictly a contractual issue between employer and employee.
