A former Long Beach high school football star convicted of raping a classmate a decade ago had his conviction dismissed Thursday after his accuser recanted her story.
Brian Banks trembled with sobs after a brief hearing in which prosecutors said they had no objection to his conviction being reversed. His mother and girlfriend, seated in the courtroom, let out cries of joy.
"My only dream in the world is just to be free," Banks said at a post-hearing news conference, his eyes red from crying, his face frozen in disbelief.
Banks was a 17-year-old college football prospect when, in 2002, a classmate accused him of kidnapping and raping her. Banks maintained the sex was consensual, but his lawyer suggested he take a plea deal rather than having the "he said-she said" case go to trial.
Banks pleaded no contest to one count of forcible rape, was incarcerated for about six years and had to register as a sex offender.
In a movie-worthy twist, his former accuser got in touch with him via Facebook after he left prison. The two eventually met in person.
According to court papers, she admitted to him she lied but later refused to tell prosecutors the same thing lest she have to give back the $1.5 million she and her family won in a civil suit against Long Beach schools.
But based on the new evidence, the California Innocence Project took on Banks' case.

Why aren't the "womyn" of NOW vocal about these kinds of things? When the real rape occurs people will be less likely to believe it because of situations like this. |

do you seriously want to go there?
that an org founded on defense of women's rights, including equal pay, domestic violence, access to employment, and among other issues, better prosecution and defense in rape and other assault cases should delve into this one unusual instance of a rape victim recanting her testimony?
it's quite interesting that this individual accepted the plea deal his atty offered even though he claims he was innocent.
no one except those who were there, actually know who's telling the truth - he could be crying because he never expected to have been in prison for RAPE - duh!! and the woman could have recanted because she wanted to, period, felt guilty, etc., it's really not at all unusual for ANY sexual abuse survivor to experience mixed feelings and ambivalence about the perpetrator.
yes, there are women who lie, cheat, steal, murder, etc. etc. etc. that does nothing for the facts/statistics regarding women being murdered by their boyfriends/husbands/exboyfriends/exhusbands and how often it happens, even WITH court-ordered protection orders in place.
for just ONE example, until a few years ago, Texas had a law in place that allowed a man to kill his wife if he found her in bed with another man. however, that only applied to the husband - if the wife found her husband in bed with another woman, she could not kill him and get away with it.
this is the kind of discrimination that NOW was created for, and has, gone on to change
while it's unfortunate, of course, if this fellow really is innocent; you are only potentially hurting other future victims if you believe this is a common occurrence because it's not.
in fact, there are many situations where sexual abuse survivors have been punished/threatened and even killed for making accusations against their attackers. I'd like to think you are intelligent enough not to expect society to return to those days. |

Hey Lady,
Not just one but how about others and there have been plenty of others - the Duke La Crosse case for one.
I'm not saying that rape and other bad things don't happen but where are the new conferences specifically geared to tell women not to make false claims such as these?
Also "women's rights"? Get real. Since abortion was legalized scores of females have been murdered by abortion in the USA.

I would be hesitant to associate NOW with this matter. Its tragic. Its an outrage but its not NOWs fault.
As for his taking a plea, anyone who has any familitarity with the justice system, especially in large urban areas knows about situations like this.
The poor can't afford good represenatation and the odds are he would have been found guilty and did more time.
The pride, honor and self respect in all of us says you would fight it in court and damn the possible consequences. The fact is if you were faced with spending the majority of your life in prison if you fought it and any one associated with the system would put the odds of your being found guilty as a very good chance I think you would change your mind about not taking a plea.
With any change in society the pendulum often swings way in cases. Unfortunate but it happens and over time it does (or we hope) get back to a more reasonable standard.
Its like blaming the NAACP for something blacks do or the main Jewish lobby for something Jews do.
Its unfortunate though and it not only hurts men obviously but hurts legitmate cases by women because the more of these types of cases that are made the less we may believe legitmate ones. |

NOW bears at least responsibility for this. Where are the interviews, forums, etc about how women's false claims of rape can lead to a boy who cried wolf mentality among the public. The same would hold true for any group that refuses to say much if anything at all about false claims of racism, etc. |
