there is a teacher I know. She wanted to file a grievance with the labor board or whatever about her former hagwon over salary unpaid. However she was concerned because she had worked part time and was taxed on that part time work. Will she be investigated as well if she brings the grievance to the board about unpaid salary? Is it worthy it for even to bring the complaint?

Immigration does not care. They only deal with immigration issues not work or hagwon issues. Wrong department. She should check with Labour department for unpaid salary. For taxes well the tax department. |

How exactly was she taxed for salary unpaid? Your premise is a conundrum. Either she got money or she didn't.
Are you saying the unpaid salary is the difference of the total and the portion that was actually paid? |

no, she wasn't paid for her work at her hagwon. however she also worked on the side additionally part time which was also taxed, meaning not cash and carry. |

Labor board doesn't talk to the tax office.
The tax office doesn't talk to the labor board.
If she was working legally and there are unpaid wages then file the complaint.

The primary job with the academy was in contract and legal. Her second job was a part time job that was taxed.
The primary job did not know about the second job. |

not relevant information.
ALL the labor office wants to know about are the specifics of the grievance:
(time worked, wages unpaid, verification (copy of the contract), pay slips, receipts or bankbook to verify wages).

How did your friend end up paying tax on the part time job? Is she on an E2 visa? If so, and the part time job was illegal, then she (and everyone else) should make a note to themselves. "Don't leave a paper trail when you do something you're not supposed to be doing."
Was the money deposited into her bank account directly from the school? If so, what does it say in her bank book? Does it say the name of the school or does it just have a generic looking entry? Approximately how much was she making on the part time job?
The reason that I ask is because your friend may have to show her bank records to prove that she wasn't paid in full by her primary employer. If the part time job was paying a significant amount then some office worker who looks at her bank statement might ask about the extra payments. True, the labor board doesn't care about your part time job. They're more interested in whether workers are being treated properly than whether or not someone is breaking an immigration rule. Still, it's possible that someone else could hear about it. She should probably clear it up right away with the labor guy she shows it to so that he knows that the other payments were from a different employer so that the issue does not come up again when someone else might hear mention of it - e.g. her ex-employer or immigration.
As far as having paid tax on it, she shouldn't worry because it's another office. Labor would only care enough to check on taxes if you claimed that your current employer wasn't paying them for you. |
