So I'm an F4 visa holder. The MoE requires a background check for F4's now. I have 3 drinking tickets from my wild college days. It will probably show up on my background check, although I never was convicted of a crime because of several factors, I've been arrested for drinking, fingerprinted...
My question is can the MoE tell me I can't be a teacher because of an arrest record? Or is this decision only on the hagwon's discretion? Ironic because of the drinking culture here....

IF your check comes back with a positive finding (anything other than, "No derogatory record found") the MOE can and probably will refuse to register you as a teacher. It is not at the discretion of the employer.
Any employer hiring you and not registering you or keeping you employed after your registration has been refused/revoked is subject to penalties ranging from fines to loss of their business and operating license.
Time to start looking for a new career path. EBSE???
