Hi everyone,
I've been searching the forums for a bit now and I can't find an answer to my question. I need help. PLEASE!
My current contract finishes on August 15th. I have an E-2 visa, and it expires the stadard 1 month later on September 15th. However, I need to go home after my contract is over. I plan on returning September 1st.
Will my visa still be valid, or will it be cancelled because I am going home after my contract has finished?
I have heard both answers and need to clear this up urgently because I will need to rearrange/cancel any flights ASAP!

On August 16, go to immigration and switch to a D10 visa.
It will give you 6 months to look for work.
You can exit and return without risk to your status.
It will save you needing to get new documents to change back to an E2 when you find a job.

Damn, I got my flight leaving on the 15th, and that's a holiday so they'll be closed!
Still... it seems like a lot of hassle. Is anyone sure if I can just leave and come back? I'm returning before the expiry date so I don't really see a problem... right?  |

I would go to immigration with the flight information and ask immigration in person. Since you are asking about an exception to normal procedure, an officer would be the person to know and approve an earlier D10 issuance (if the 16th is actually the earliest). I would just say I finished this week if the school was ok to support you on that, but maybe you don't need to if immigration is willing to help out. |

Be careful with that advice.. The minute you apply for a D-10, you loose your E-2 status, and are no longer permitted to work. If you get caught, you WILL be fined and deported. Immigration never goes lightly on someone working without a valid visa. |

So you want to use special procedure for people staying in the country, but not actually stay in the country. I can't see how anything will go wrong. |

Just curious as to what you ended up doing and if you got any more information about this. I'm in a similar situation - my contract ends beginning of October, my visa expires beginning of November and I have a new job starting late October. I want to go home for a week or two, come back a few days before I start my new job and transfer my visa then.
I'm going to call immigration but sometimes they give conflicting information so I want to see if anyone else has done this before. |

Go in to immigration at the end of your contract, transfer your sponsorship to your new employer and extend your status of sojourn then take your holiday.

Thanks ttompatz. I called immigration and they said it's ok to finish my contract, take a vacation on my current visa, come back and then transfer.

i just got back last weekend. first thing monday i went to the immi office and got a d10. boom. |
