 Posted: Sun Sep 02, 2012 5:30 am Post subject: Leaving a job early on a F-4 VISA |

| so i'm in korea on a f-4 visa and working and living in a not so big city. maybe its the culture shock or what not but i was wondering what the repercussions would be for me if i left the job early? i'm about a few weeks into working and hating it. there were clauses like repaying back the flight costs, recruiter costs, etc if i didnt fulfill the contractual obligations. can they do anything (like suing or any other legal actions) if i pack up and go somewhere like a different city in korea? how about back to the US? another thing is i included my US address on my CV so they know where i live... |

Pay back the airfare (if you owe it) and walk at your convenience.
There are no repercussions other than a bad reference.
It won't affect your visa status.

| I think it would be fair to pay back the airfare if you want to leave. Recruiters don't usually get paid until three months have passed so don't worry about paying back the recruiter fee. They could sue you if you remained in Korea but given the cost of lawyers here it's very unlikely. They may know your US address but what could they do? A contractual dispute in Korea is out of the jurisdiction of the American legal system. |

| what about the whole "giving 30 days notice" and wahtnot? if i go and tell them i cant work there anymore and quit working there the same day can they do anything for my life in korea or back in the states? |

Other than give you a bad reference = no PROVIDED you have no outstanding debt (like airplane tickets).

| so a quick update... i didnt want to pull a midnight run and have them wondering where i went for a few days, so i told them i would be quitting and they told me that if i didnt hand my passport over to them that they would report me to the police and have me arrested... and i did. i guess they're trying to make sure i don't leave korea anytime soon until i pay off airfare and other fees. any way to remedy this?? i know that i can notifiy the embassy that i requested my passport back and they refused but that'll bring the whole school down with court appearances and such if the US embassy gets involved so im trying to avoid that. i get the feeling that the whole "you're going to the police station if you dont hand over the passport" threat was a bluff... but will i encounter any issues with immi? |

NEVER, NEVER relinquish your passport!!!!!!!!!!! Get that back ASAP. If they say they're going to call the police, tell them to go for it. In fact, tell them to call the police so that you can demand your passport back officially. It is the property of your home government and you are the sole legal carrier.
Your visa gives you employment rights and privilages equal to those of a native Korean. You are only required to provide notice in accordance with Korean labour laws, but contractual terms can supercede this if stipulated. ttompatz is up on all the official regs.
If you owe them the airfare, pony up. Same with other incidentals they incurred from bringing you here and setting you up. Would have been better had you stuck it out, but it's tough to say given what you've told us. Next time, think before you sign, and think carefully. |

Give yourself a smack in the head with a big ID10T stick.
They are liars and you fell for it.
Now you get to involve the police or embassy or pay the blackmail.
If they have more than 10 days of employment that you have not yet been paid for then just leave and call their bluff (the unpaid wages more than cover your air ticket).
GET the embassy involved.
File a complaint with the labor office for unpaid wages.
File a complaint with the police for a stolen passport (you will need the police report to get a replacement passport from the embassy anyway).

I don't mean to troll. I'm just shocked that anyone would hand their passport over like that, especially after being threatened like that("We'll call the cops if you don't). You could at least just say you don't have your passport on you at the moment, that it's in your apartment somewhere, then go ask for advice from friends or this board before handing it over. |
