Officetel Owner stalling for time with Deposit Money

I gave the owner of my apartment over a month's notice to pay my deposit. He keeps making excuses and says he needs another month, which is unacceptable as I need to put down the deposit for my new place ASAP. What actions can I take to rectify this, and can anyone site any websites with Korean Real Estate law regarding the one month notice?

I can't help you with real estate law, but your landlord may be waiting for the next tenant to move in, collect his/her deposit, and give that to you. If you know anybody that can take your place, that may speed things up regarding your deposit.

I can't cite anything, but I thought that the general rule was you stayed the whole term of the lease. When your lease is up, you get your money.

If you leave early, then you DON'T get your money UNTIL they find someone to take over the lease.

So, did you stay the whole term, or are you leaving early? If you're leaving early, I THOUGHT the rule was they kept your money until someone else moved in, OR until the lease was to be up originally. But like I said, don't quote me on that.

I had this happen to me before, in my case the landlady was gettinga divorce so she froze all her assets, so I took her to a lawyer and she had to sign a document that cost me 25000 won that said she will pay by X date if not she takes full liability and will be subject to a lawsuit in court. Of course it is usually hard to get this because you need to physically go with them.. At any rate a Korean talking to them is the best way to go in terms of threats of legal action.

Then he's having troubles finding a renter.

I'd go back to your old apt and see if anyone is living there. My old landlord wouldn't return my deposit even after someone moved in. If there is someone living there go straight to the police station.

The lease was legal and handled by a budongsan. I've already moved, but I work in the area of my old apartment and know the owner's address and contact info. He is supposed to pay by today, will let you know how it goes.

He said he could only pay half today! He wants ANOTHER week. I have threatened him and I have no idea what else to do. So stressed out.

I was having a similar problem with an apartment rental deposit. I sent the landlord a text telling them I could wait for a court case to give me the money and I was going to the Tax Office at 9am the next morning to report the rent I'd paid.

I had the money 30 minutes later even though they couldn't read the English text message I'd sent them.

The Korean owner of the officetel my wife and I lived in pulled the same thing; said he couldn't pay back the deposit until he found a new renter, which was total BS. We had already completed our lease. Anyway, we didn't get our money back until we got our Korean boss' assistant to speak with the owner. It still took a few stressful days even after that. I hope you get some help. I'm sure there are many foreigners who get screwed while planning to end their lease around the same time that they leave the country.
