Just a quick question. Contract states 10 days vacation per year split between summer/winter. Just wondering if weekends can be included in those 10 days? My understanding was that it was 5 paid days off summer/winter, not 3 paid days off through the week and the two unpaid days of the weekend. Have I misunderstood or is my employer trying to pull a swifty? |

What does your contract say? Does it say that you work Mon. - Fri? It should be 5 weekdays off not including the weekends or national holidays. What some places do is take a thurs to tues. off to make it look to parents that the school didn't take a full week off. You might have to fight for that extra day. |

It is 10 WEEKDAYS paid vacation. Weekends are not counted. If they are trying to count weekends in - they are pulling a swifty on you. Tell them that you'd like them to call the education office - with you there so you can talk to them too if need be. |

The education board does not care. The labor board will care a little bit.
To the OP, generally vacation days are given for work days! So unless you work on a Saturday or a Sunday regularly, those do not count. |

My contract states I work Monday to Friday and that I am entitled to 10 days paid vacation per year. I was informed today that summer vacation will be from Wednesday July 31st to Sunday August 4th and therefore returning to work on Monday August 5th. |

My boss tried to pull the same thing in my first year. I just stood my ground and insisted that weekends didn't count and she gave in pretty quickly. Not surprising as she was so obviously in the wrong. I felt bad as the Korean teachers only got three days but vacation time is too precious as it is in these contracts. |

LABOR LAW ( http://www.moel.go.kr/english/topic/laborlaw_view.jsp?idx=254&tab=Standards ) says you are entitled to one (working) day of vacation time for each month worked
IF you have worked for less than one calendar year
AND you have NOT taken a day off for other reasons.
IF you have been there for a full year you are entitled to 15 days of paid annual vacation.
Sounds like Your boss is trying to pull a fast one.

I guess that's another thing that's written, but not actually practiced in the hagwon business. Has anyone gotten those extra 5 days after working at the same company for more than a year? I'm thinking about negotiating for that next contract renewal. |

Try dropping a copy of the labor standards act (relevant sections highlighted) on his desk when you negotiate.

thanks ttompatz. i got word today that i can have from the 31st july to the 4th august but because i will still be owed 2 days annual leave, hes offered me from 14th august to 18th august as well so effectively i get another 5 days straight because of the national holiday on august 15th. so i guess my question now is, do i accept the 2 lots of 5 days in a row or fight to get 9 days in a row? im not going out of country for summer vacation but am a little worried that come winter vacation time when i intend to head to japan he might try to break my holidays up again and i want the 9 consecutive days in winter for my trip. any advice would be much appreciated  |

Provided he conforms with labor law... the best you can do is ask well in advance and negotiate your best deal. Put it in writing.

My work has the same idea for holidays and did the same last year. It just works out that at the end of my contract I was paid for any days I did not take during the year. |

Can you tell me which article of the link you provided talks about the extra five days vacation? Nothing I see talks about vacation at all. |
