Hi everyone.
Does anyone know what the rules are for release letters and transferring e2's?
My contract will be fulfilled at the end of July (not quitting/fired) and I want to transfer my e2. My current employer is refusing to sign a release as they are upset about me not wanting to extend my contract.
Do I really need a release if I'm transferring my e2 and completing my current contract??
Thanks for the help. In a bit of a bind. [/i] |

No, no LOR needed.
IF you are finished the contract and your ARC should expire soon after. If so, then you DO NOT NEED a LOR. Immigration only needs the LOR if you are quit or fired. Bring your contact with stated dates when you go for a transfer+extension. The D-10 is another option.
The LOR is good to have even if you do not need it. It just allows things to go easier with immigration.
Do lead the school school on and do not tell them you do not need their permission. Make them think they have you by the balls until you have moved on.

I would make sure pension funds have been made and you receive your severance is received before you move on.
Sometimes, this precludes being "hung by the balls".
So, play your cards right. Get your money. I try to avoid legal disputes. |

Got it. Thank you!
Just to confirm, a visa transfer does NOT require a new CRC, diploma check, etc. Correct? |

Generally NO. It is up to the discretion of the immigration official granting the transfer. If something has changed or need to be updated they may ask for. (Ie, old State Level CRC - FBI Check will be asked for). Yet once again for transfers you do not need to submit new paperwork.
I will add the caveat of you will likely be asked to get a new health check. Renewing with a school your can often skip, changing schools you will maybe need a new one.
Please do check out the HiKorea website for details on transfering. |
