I have been working in the same place for two years now. i was approaching the end of my contract again and we were making teaching plans as usual for the next teaching year. I stupidly didn't discuss the extension of the contract because things seemed to be going well.
However, two days before my contract is due to expire, I have been informed it will not be extended.
Is there anything I can do about this or do I just have to get out and start trawling the job boards again? |

Legally they had to give you 30 days notice of non-renewal or being fired. Really what can you do though? Just switch to a D-10 so you don't have to submit all new docs again and get to the hunt. |

Wow... you waited until two days (actually, you didn't wait, they told YOU) to find out you weren't being extended? Most people discuss these things one or two months in advance. I discussed my extension with my employer something like a month in advance. If a school wants to keep you they will ask you to stay.
Life lesson learned. |

Actually, no.
A fixed term employee does NOT need notice of non renewal but their not telling you was certainly in bad form.
Go to immigration (BEFORE your ARC expires) and change to a D10.
You'll need:
passport
ARC
application
Fee (50k)
Plan for a job search (written on an A4 sized sheet of white paper).

Fixed term employees at private universities are legally supposed to get 2 months notice if not being renewed. A friend had this happen to him, he went to the labor board, and his school was required to give him one more yearly contract. It was his last year in Korea, so he didn't mind not getting a glowing letter of recommendation.
Private Schools Act:
(4) Where the term of office for teachers appointed pursuant to paragraph (3) expires, the person who has the power to appoint and dismiss shall notify (referring to the notification in writing; hereafter in this Article the same shall apply) the teachers concerned of the fact that the term of office will expire and they are eligible to apply for re-appointment deliberation, not later than four months before the term of office expires. <Amended by Act No. 7352, Jan. 27, 2005>
(5) Where the teachers who are notified pursuant to paragraph (4) intend to be re- appointed, they shall apply for re-appointment deliberation to the person who has the power to appoint and dismiss within fifteen days from the date when they are so notified. <Newly Inserted by Act No. 7352, Jan. 27, 2005>
(6) The person who is requested to deliberate upon re-appointment pursuant to paragraph (5) shall decide on whether to re-appoint the teachers concerned after going through re- appointment deliberation by the teachers' personnel committee under Article 53-3 and then shall notify the teachers concerned of the contents of the decision not later than two months before the term of appointment expires. In that case, if he decides not to reappoint the teachers concerned, he shall specify in the notice the purport of and the reasons for refusing the re-appointment. <Newly Inserted by Act No. 7352, Jan. 27, 2005> |

OK there has been a whole lot of discussion about whether they had to give us private univ teachers 4 months notice when not renewing, this looks like it confirms its two. I know in Sept, I'm given a form asking if I want to renew
Man I could have nailed my former univ a few years ago, they gave me 6 weeks notice. Heck I was going to leave anyhow for my current gig, I was just waiting until I got back from vacation to tell them in person. |

Yeah, it's 4 months to let you know that the contract is almost up, and that you're eligible to apply for renewal. That part is kind of BS, because who doesn't keep track of how many months they have left? They only have to give you 2 months when it comes to letting you know if you're being rehired, though. |

First off, I'm sorry you're having to go through this. However, I do think you should have taken the initiative before this and made sure of what was going on.
But if I'd been a good teacher for them for 2 years and then they waited until now to tell me they don't want me anymore... Well, I'm not sure I'd want them either.
Good luck with everything and I think you should just find another place who wants and appreciates you. |

I don't see anything wrong with the employer. I worked one place on contract and arranged my next years contract at a different school without telling them. I think if you never talked to them about extending they probably thought you didn't want to.
Unless you talk about extending, I think it is fair for both parties to assume you aren't.

Presently I'm working public school with my contract ending in 3 months (yes strange date - November). They asked me if I'm going to renew and I said I wasn't. So now they are sad, and acting like I'm betraying them. If they wanted me here long term, they could offer me a permanent job. That's the nature of contracts. |

my last univ didn't even do that, at least Hongik did that you filled out a form in Sept and in LATE Dec they let you know, too late to get on at another univ though, the univ before that didn't do it. One teacher wound up taking a former univ to the labor board over that and won his case, they didn't tell him squat until Dec they weren't renewing him. Guy was a jackass but glad he won the case.
Too bad I can't do anything 3 years after the fact for my last univ. I would have been so shafted if I hadn't landed another job in Dec. I will let my friends who still work there know |

^^ I 've experienced this reaction in both public and private schools. I've never quite understood why they feel so betrayed and violated when someone decides not to renew.
One of my private schools took it to a whole new level. After slaving faithfully for three years, Within two months of my contract's end date, I announced that I would not be renewing.
When my new employer called to verify my years of service, (so I could get a much higher salary) the owner said he had NEVER heard of me and hung up! Really? That was my reward for building his English department?
But of course since I had photos, pictures, videos my new school realized that he was angry at me for leaving. |

Yes, I vouch for that. 5 years of faithful service with a great relationship has become soured when I informed the principal that I will not renew. They still need a lot of growing up to do.
My dad always told me that it's best to avoid the crowd of miserable and negative people. I've decided to follow his advice.  |
