Sometimes they have a 10 day clause. I think it means that if you get a flight during this time, then you are owed money. After that, they don't have to pay it.

If you are more worried about theory, then yes you are "owed". If you are more worried about getting the money, then yes you are DEFINITELY "owed" and you should collect on it now not later. |

Why not make sure all your concerns are addressed in whatever new contract you sign? |

You will have to extend your visa with Immigration and to do that you will need a contract or extension agreement of some kind. This can be a simple document that continues the previous contract along with a few additional provisions.
Your extension agreement should require that your boss pay you for your 1 year airfare that you will have earned as of September 9th, on that day or on your next scheduled payday - which ever will make everything go smoothly. This payment need not wait and you should not wait for 2 additional months. You have now earned it. Put a fixed cash amount for the ticket in the contract. You can look up prices on one of the many cheapo airfare sites and print out a copy.
Your agreement should also spell out that you will receive your severance pay for the full year plus a pro rata amount for the additional months you are agreeing to work to be paid on your last work day. If you are extending exactly 2 months, then that would be a full month's pay for the full year plus an additional 2/12 month for the additional 2 months. You can do the math and write out the simple terms. You should continue to be paid monthly and all final amounts due should be payable on your last work day of your extension agreement. It is no longer legal to pay severance early, so the entire amount for 1 year and 2 months would be payable to you when you finish working with this employer.
Your boss should be willing to sign this and keep things running smoothly. If not, your contract ends on September 9th, you are due your airfare and severance for the year, and you are free to leave.
Write up the extension yourself and if you are working together on good terms you should have no trouble.
