Where did you hear that the regulation came back? (I mean, what's your source? Can we check it?)

If the rule is back, it's stupid. Why should some scumbag boss, just out of spite, be able to prevent you from getting work? The worse the school is, the more incentive the boss has to scare teachers by denying release letters.

I recommend that people ask their local Immigration office. But do it BEFORE telling your employer of your desire to quit. Then, if Immigration says "no" to your D-10 request, you can still turn back on your decision to quit. (This of course doesn't apply if you've been fired.)


It is not stated on any site that I have noticed, but people have been mentioning on Dave's since about Feb of people not being able to do the runner anymore. NYCGal was one of the first to point it out. Yep, it is a crappy regulation.

You are also correct in asking immigration for advice before running. Problem is at times it can get really confusing. One, immigration has the tendency to give different answer for the same question. Two, immigration at times just does not care about things or issues. They do not care if you boss is a jerk, they just want to make sure you are legal. Three, immigration has sometimes spilled the beans on things. Not often, but sometimes word gets back to the boss.

For those arguing semantics on terminology. True, immigration does not GIVE a D-10 in the bridging visa case. The transfer/change a visa to D-10. The previous visa (E-2) is sort of canceled but I would say more a transfer. Immigration for many transfers either needs permission (LOR) or completion (contract finished).

It seems a mixed bag if you quit. But what about getting fired? Can you argue wrongful dismissal and get a D-10? What about not getting paid? Can you quit then and get a D-10?

Always seems confusing as I've never had to go for one myself.
