Hi Friends,
I applied for an E-2 but I was rejected. I am not exactly sure why but my contact at the school said that immigration was suspicious of the jobs I had listed on my resume. One job indeed was probably a red flag because I was working there on a student visa. I didn't know I had to report the job to immigration since it was only part-time. I have recently learned that I indeed needed to. In any case, immigration said my dates didn't add up to the visasI had in the past and they were suspicious. I explained to the school about my jobs listed but I think they didn't want to go back and explain it to immigration. My contact said that the HR department didn't think I would have a shot so they won't go back. Now I don't know what to do. Not only have I spent a lot of time and money getting my documents, I also was really looking forward to my position. Furthermore, I have heard that I cannot reapply for the same visa since immigration has already deemed my application invalid. Does anyone know more about this? I am disappointed and stuck. Also I want my documents back (CBC/notarized diploma etc..) The contact at the school said he would ask HR about it. Is there anyway to demand them back? Once I apply are they lost? Thanks so much! |

Why aren't you going to immigration in person and explaining it with the school? You were on E2 before, then went on a student visa? What EXACTLY is your work history? Take out the illegal work, and list things according to your visa. What is the work history that would relate? |

Are you sure, you didn't list part time work? (illegal jobs)
If you did, I'm afraid you're done as far as Korea is concerned. Immigration might be lazy and incompetent but they aren't stupid.
In short, your story doesn't add up. |

Does anyone know if you can reapply for an E-2 visa after getting rejected once? Also I have just heard back from my contact at the job and this person said that all my documents have been returned and I can pick them up. This makes me believe that they didn't actually apply for the visa. I think immigration may have advised them to get clarification on the 'sketchy' parts and come back. I don't think it's worth pestering this job to continue because it seems that they don't want to pursue a visa for me. I thought once immigration processed the documents they wouldn't be returned regardless of the outcome. Does anyone know if this is true too? |

It sounds like the OP made the mistake of doing just that if the timeline of the jobs and the visa timelines didn't add up.
By the way I know exactly how you feel. I was confident of getting an employment visa for a job in Saudi Arabia in about a month after I turned in all the required documents. After three weeks I get a notice that they need additional information from one of my universities (that no other immigration agency in their right mind would need). The university (a major research institution) declined saying "we don't give out that kind of information to anyone, what they want is really odd, we've never heard of this before". When I was hired for the teaching job, I had to go back to the USA to do the medical portion of the application in the USA. I thought after spending all that money it was finished and over with. Imagine what was going through my mind. All of a sudden Four to five months later I find out my visa unexpectedly arrived. I had already out of desperation taken a taxi job just to get an apartment and recoup my savings. Your situation is a piker compared to what I went through.

Why are you dodging everyones questions?
I agree that your story doesn't hold up. Seems you were rejected, you're leaving a big part out of your OP, and you're just trying to weasel your way into Korea.
Not going to happen. Korean Immigration does NOT mess around. |

You need to contact the Korean embassy about whether or not they outright rejected you. It is very possible the school is simply saying whatever they want to regardless of what really happened. |

With that in mind how would you know that he is trying to weasel his way into Korea? |

Thanks for everyone's responses. They were all incredibly helpful. If anyone else has any information about whether or not you can reapply for an E-2 visa if you have been rejected please let me know. |

Of course, the gaps in your history aren't what immigration is worried about. I think they thought you taught while on a student visa though. Again, you haven't told us your history.
Since you haven't given more information, I must assume you are hiding something. Good, hide it more. Find a different area to apply for your E2 visa. My current school had to make it look like I worked 1 year contracts and completed them. I even had to go in for a face to face interview (this is China though), I have never had to do this in Japan. Korea, or China until now.
Anyway, they need to see some reasonable work history. If you were a student, make it look like you did a lot of extra work. Say you learned taekwondo, you took extra classes in hanja and baduk. |

Yes, you can apply again. In fact, you can apply as many times as you want to. Apply, apply, apply.
Whether or not any of the applications will be accepted--well, you'll find out eventually. |

If you're licensed to teach in your home country apply to the public schools in Taiwan. They're supposed to be better than Korea. |
