|
|
I seem to have lots of friends in legal bother these days. I have another friend who reversed into a taxi, scratched it slightly and the drove off. The taxi driver called the police and it got classified as a hit and run.
Unfortunately this is his second offense so they threw the book at him with a 5 million won fine. I think the threshold for deportation is 3 mil.
If his school says they really need him and he pays the fine, is there any chance he might escape the deportation order? |

Airfare home should only be about 1,000 USD. So, no I don't agree with the original poster's garbage. You can leave and re-enter numbskull at half the price (with a 2nd hagwon, yo wee yo!!!).
Yea, we fine you 5 million won.
You go home for 1 million.
What we do for the other 4 million? LOL
Korea has no collections department. Stay frosty, that's what the preacher man says. |

the first time I heard of it was for Joe at Zenkimchi's case. It definitely exists though.

McPherson certainly doesn't seem to fit what is largely an unfair stereotype image so often portrayed in the local media of an unqualified language-tourist, just here for the money, the parties and the girls. Yet, he is now facing the possibility of a law suit for alleged libel. If a fine of more than 2 million won is imposed, he could also face the prospect of deportation. |

The Korean law recommends that foreigners should only be deported if they commit a crime requiring incarceration. At the beginning of this year, they tried to deport a Chinese immigrant who was fined 5 mil. won for drunk driving, but upon appeal the courts ruled that deportation was not justified. The ruling specifically stated that deporting foreigners for a fine alone was "too harsh."
ETA: the law was revised a few years ago; I see that the link refers to a case in 2007. I just looked at the wording of the law and it specifically states that foreigners who are incarcerated will be deported after they have served their sentence. Fines alone are not enough to get a foreigner deported, strictly speaking. Of course, if you're unlucky you may get hit with a deportation order anyway and have to appeal, if you have the resources to do so. |

Unless said fine is not paid, in which case detention can be in the cards.

I think they sent him a text message in korean (which he didn't understand) saying that he had 15 days to respond if he planned to contest the fine. He didn't respond meaning that he accepts the fine and has agreed to pay it. |

As long as he pays it on time there shouldn't be a problem. A lot of crimes come with two kinds of potential punishments: a fine or jail time. The jail time is for people who can't/won't pay the fine, so if he pays the fine he shouldn't have to worry about deportation, barring a set of unusual circumstances. |
