|
|
Hello Guys! I have an E-7 Visa and work as a software developer in E-commerce company. I have been working here for 2 years, but my contract is for 3 years. In contract it is said that I can leave the company within 30 days after I inform my intention to leave. So, I want to stop my contract with current employer and change my work.
However, my boss is saying that I am a key developer in the company and he never gives me or government a work change permit letter, so I can not ever get Visa to Korea and work in any Korean company.
Can he actually do that? What kind of documents needed to change job for Software Engineers? This is the first time I am hearing that me or government needs a work change permit letter...
I have not had any legal issues, however I wrote a Letter of Apology because I did not follow the coding rules of the company. When the deadline is coming and you have to finish a project, you should code very fast so you do not think any coding rule. However, I already corrected all code according to the coding rules of the company. So, my boss is saying that, that apology letter will play against me if I complain against him to government organization. But, I am not a child and I know my rights, and that apology letter is nothing but a piece of paper.
So I was really shocked when he said that. Actually I am a well-educated and experienced Engineer, and I did my Master's degree in Korean University, and hearing such words make me really annoyed. And I want to change my job as soon as possible because of that.
If I change my job, will I have any legal issue? If my current company doesn't give me required documents in order to extend my Visa, what kind of issues I might have?
Thanks for your time. Have a good day. |

Can he NOT issue a release = yes.
Can you quit at your convenience = yes.
Can he prevent you from ever working again = no.
Can he prevent you from working elsewhere until your visa expires = yes.
AFTER your visa expires you can find a new job and start again with a new visa.
Quit at your convenience.
Leave Korea and cancel your visa.
Just be aware that you may NOT be issued a new visa until the expiry date of your current ARC.

Thanks ttompatz for your reply.
I have another question. Actually I am going to study in the courses of KIIP(Korean Immigration and Integration Program) program and get F-2 Visa. Will this Visa give me the right to easily change my current job? |

Absolutely. If you get the F2, your employer will no longer be sponsoring your visa and you will be free to change employers as you see fit. |
