Furthermore, I wasn't obligated to file a return at all since,
the alien resident is not required to file the yearly tax return if he has one of the following things.
1) Only wage and salary earnings from which his income tax was withheld and paid by and through the employer or taxpayers associations. |
But they weren't doing that. You took their word for it without checking. Your employer not filing your taxes correctly is also not the responsibility of the tax office. I still fail to see where the tax office broke the law. I imagine your lawyer did too since apparently you failed to repeal the fine despite an inch-thick binder of evidence. That or you need a better lawyer.
Yeah it's sketchy and corrupt as all hell. Hell, it's a system almost clearly designed for Korean employers to screw their foreign employees. Either it should be changed, or there should be some kind of laws in place to prevent shit like this happening, but whether you want to hear it or not, you still could have prevented it by checking to see if your taxes were being filed properly years ago. |
The bold part is the truth. The rest is blame the victim, sort of, "it could never happen to me" stuff. It happens all the time, but most people have left the country so it doesn't matter. |

This guy still doesn't get it. I did everything that could reasonably be expected of a foreigner working his first year in Korea.
I read the Labor Standards Act.
I kept all of my pay stubs.
I submitted those pay stubs to my employer in 2009 for the year 2008.
They claimed to do them
They handed me an official tax return receipt and I even received a tax return.
I, in no way whatsoever, neglected my duty to pay taxes and file a return yet I still got screwed.
Because...
my 2008 employer lied about my employment status, lied about my income, neglected their legal obligations
my 2009 employer ignore the pay stubs I gave them, only filed taxes for January and February 2009 in February 2009, something which should be impossible. How on earth can you file a tax return for only 2 months of a year that isn't finished yet? And silly me I believed it was a tax return for year I had asked for thinking it impossible to do so otherwise
And finally, because the tax authority let all of this illegal activity occur, failed to notify me with any effort at all, and then refused to even hear my case once I was finally notified. |

Guy comes to Korea. Tries to follow the rules.
In Korea the employer has to file tax returns for all employees. They said they did it...
Two years later the tax service fines the employee $4000 for tax evasion.
He tried to be a good foreigner.
He tried to understand the local laws,
but he couldn't account for all the culturally acceptable cheating that goes on.
And now...
he's back...
and it's...
PAY DAY
