It is a warning for young people going overseas to teach English, not to expect the same rights often taken for granted here.
A Canadian woman sexually assaulted in South Korea has learned she could face charges for testifying in court.
The woman — whose identity is being protected — was attacked last year.
The man charged was known to police — accused in a number of other attacks.
She was followed walking home from work, that part, caught on video surveillance.
“And then he came inside my apartment building and sexually assaulted me.”
She reported it to police.
“They caught him, soon after, in a different neighbourhood, preying on a different female.”
She says the suspect was known to police – a wealthy professional with half dozen other victims.
“His family started coming to my apartment building, because in Korea you are allowed to bribe the accuser not to press charges.”
She wouldn’t take the money, the case went to trial, and she won.
But , it was thrown out on appeal.
“The first trial, I won the first trial…and then during the second trial, he won…and he won because it came out that the original police report didn’t say that I was raped.”
After all of that, when she was finally, able to move on, a bombshell…
“I decided after that point just to close that chapter in my life and move on, and then this just reopened everything, all over again.”
The man she accused is going after her in court.
”He is now trying to press criminal charges against me, so I have to speak to the police officers. I’ve spoken to them once. He’s trying to charge me with false accusation and perjury, basically lying on the stand.”
On top of the stress of facing jail time — she’s now saddled with the prospect of legal fees.
Although she’s worried about the possibility of jail time and expensive legal fees, she wants to stay in Korea, a country she has called home for six years.
Friends have set up an online fundraising page to help her with legal costs.""

This guy should be locked up for life, not awarded.

Quite often Koreans take the settlement offer. The article says the guy was rich. How much was offered?
Sexually abused people in the west usually accept compensation payouts.
She wanted to see the guy go to jail and it didn't happen. If she could do it all over again would she take the money instead? |

I don't want to speak for her....but I know if I was assaulted....and found out that person had a history of assaults I would rather put the guy in jail so that he wouldn't have the chance to assault more people instead of taking the money. I'd guess most normal people would feel guilty over taking the money knowing that you're allowing a serial rapist free to rape again. |

I can't speak for her also. She has her own life to think about. But I'm with you. I would rather he be worried about picking up the soap. |

Considering just how common blood money is used here, it's not entirely surprising.
It would also appear that he has decent lawyers - and the police is utterly inept (a reason why he got the initial decision appealed). |

I'm going to be the asshole here.
This article (which doesn't exist at the link provided) is only telling her side of the story. Why didn't the police report say that she was raped? That seems like something you or your lawyer would have made pretty clear.
Not that I have much faith in the Korean justice system, but there's just not enough here to justify hauling out the torches and pitchforks just yet. |

The police didn't write raped because they're racist f@kers who protect their own. The judges also do the same. Man is King in Korea and women are lesser creatures. Also, as a foreign woman, she's even lower.

This. Before we go on the usual and unsubstantiated claims of racism and sexism, its important to recognize how important money is. Rich Korean women have far more power to screw over poor Korean men and women than they do wealthy foreign or Korean men and women.
Sounds like the guy got off on a technicality and now is sending his lawyer goon squad after her.

We can't expect the system or the culture to change overnight, much less through writing angry posts on the internet. What people should take away from this is that although Korea may seem safe, it is a place where rape is far more common than one thinks and women have very little legal defense against it. Especially foreign women. Foreigners in general have little legal recourse but especially women in sexual assault cases have it worse.
Don't let the facade of safety fool you. Be vigilant. It's unfortunate we live in such a world but it is the reality we have to contend with. Your safety if your responsibility because the judicial system and the police don't care about you. |
