It used to be that we had to leave the country on the day our contract ended (which was madness). But the rules keep changing. Is it correct that we now have a month before departure is required? My public school job ends on February 28th, but my ARC card doesn't expire until the end of March. What is our legal status in Korea during that month? Does it mean that, should one take that route, we don't have to apply for a D-10 as soon as our contract ends? Can we keep looking for another month until our ARC expires. I wouldn't want to waste money on a D-10 if a new job becomes available shortly after the end of my contract on February 28th. That's what happened last time. I applied for the D-10 and within days, while the D-10 was being processed, I got a job. So as soon as the D-10 arrived I had to change it back to a new E-2.
Anyone got any insights into the current situation?

You MUST depart Korea or extend your ARC BEFORE the expiry date indicated on your ARC. There is NO exception to this.
If your contract ends and you have time remaining on your ARC then you effectively have 4 options:
1) Leave Korea within 14 days of the end of employment (unchanged in the last decade). Your ARC must be valid for the remaining time in Korea.
2) Report to immigration about the end of your employment and be granted up to 30 days (go to immigration, fill in the form for a change in employment status - get 30 days - free).
3) Switch to a D10 (looking for work visa - FEES).
4) find new employment and transfer your visa to the new employer/sponsor (fees).

As always, that you for your inside information ttompatz. My question is similar to the OP, so I will piggyback here.
Regarding point 1.
My ARC expiration date is 30 days after the end of the contract. (Contract ends July 31, ARC expires Aug 31). I plan to switch to a D-10. So I have to go in within 14 days of end of employment (August 13)? or I have to go in before the expiration date of the ARC (August 31)?
Regarding point 2.
Can this bonus 30 days be used in addition to the fact that my ARC already expires 30 days after my contract? For example. Contract ends on July 31. Go in Aug 13 and extend by 30 days. Go in on Sept 10 and change to D-10 good for 6 months.
I ask this because I am going to be in a situation where I need to use my D-10 (6 months) for the entire 6 months, almost down to the day. My contract ends on July 31 (International School E-9 Visa). My ARC ends on August 31. I hope to get a next job at a Korean Science High School or a Korean Foreign Language High School (Certified Math / Science / Physics / Computer) teacher. Those schools run on school years which begin on March 1. So I have exactly 6 months from the expiring of my current ARC (August 31) to possible start of next job (March 1). How would I use the information you gave in the previous post to keep my D-10 active as long as possible?

1) the law requires you to report a material change in your status to immigration within 14 days.
Can you wait longer = probably yes but if they fuss about it then you are screwed.
2) No. 30 days from the end of employment.
Change to D10.
Get job.
Change to new visa (up to 60 days before start date).
Extend E-visa when needed.

It takes 3 weeks to find out wether your D10 application has been successful or not.
If it isn't.. you may find yourself suddenly having to exit the country with only a couple of days warning. |

With this option, can we still transfer to a new E-2 during those 30 days without providing new CBC checks, apostilled degrees etc? Or is is understood that you will be leaving Korea after those 30 days and, consequently, would need to reapply for a new job from scratch? |
