So, a few of my coteachers(foreign) over the course of the last couple years had extended their contracts(completed a year or two, then extended for longer) and were told by our employer that they will not recieve severance for the period of extension, but only for the full year contracts they had already completed.
I'm well into my second year and am not sure if I will finish out this contract so I'm eager to get a definitive answer on this. Don't the new rules state that you recieve a pro rated severance for all time worked after you have completed one year with the same employer? For example, you finished a first year contract and decided to stay on for an extra 4 months. Shouldn't you get one year severance + 1/3 of year? And at the rate of whatever you averaged over the last 3 months for the whole thing?
I want to get this squared away before I notify my boss. I believe the other teachers just accepted it. One stayed on for an extra 8 months(worth well over a million won). That's too nice a chunk of change to just let go to avoid being confrontational.
Please set me straight. |

I should have mentioned that I work at a hagwon, not a university or public school, but I assume the same rules apply. |

Yes, the rules apply but getting it is another matter, especially if you need to go through the labor board for it.

It's not even a new rule. What's new is that employers are withholding severance until the employee finished (following extensions and such) and not paying it out every year. The rule has always been that if get paid per month of work for your entire period of employment over 12 months (unless you accepted the severance at some point and essentially reset the clock). |

If the school closes after you are owed your severance and two months pay, how helpful is the labor board? |
