Off topic, but here's a story:
At my first hogwon, one foreign teacher punched another foreign teacher for sleeping with his girlfriend. He only had 3 days left in his contract but the hogwon used it to fire him, and he missed out on the bonus, and plane ticket. 3 days left, and he got screwed. |

Great to see the message that violence doesn't pay being reinforced so succinctly |

Talk about thinking with the little head. The girl was clearly a ho, and not worth getting upset over. |

It's true, the best way to deal with the locals is to avoid them. Especially in these types of "legal" situations.
I've had numerous brushes with Korean Law, all non-violent and non-criminal, mainly to do with my car.
Once I was blind-sided by a guy on my right who decided to turn left, cutting across my lane (which was arrow-ed to go straight). He hit me dead center of my passenger side door. I was told by the police that responsibility was 70% his and 30% mine (Seems I should have hit the horn to warn off the guy in my blind spot turning into me). When I tried to protest they explained it was no big deal and the insurance companies all agree that "no one is ever 100% at fault", blah blah blah.
Fast forward a year or two later I'm driving down the highway. I change lanes in a tunnel (illegal) and then get cut off by another car changing lanes right in front of me (illegal?). I swerve, loose control and hit another car. Result: They checked the cameras and I am 100% at fault because I changed lanes. "What about the guy who changed lanes in front of me and cut me off?" says I. "If you try to argue we will arrest you and take away your license" says they.
Twice I've bought cars and tried to sell them later. Both times I could not sell said cars as they had outstanding parking tickets. When we got the records we find that the outstanding tickets were from before I bought the car. I point out that the tickets obviously are not mine. They say "sorry, but you cannot sell a car with out standing tickets"..."obviously not true" says I, as I bought the car with outstanding tickets. "It's because you are a foreigner, just pay the tickets and avoid the headache" says the ajushi next to me. |

There were no punches landed and nobody was injured other than a small scratch.
. . .
So now we hear that this executive went to a hospital and checked himself in for three weeks pretending to be injured (not sure what fake injury they are going to throw at him yet. he may use a pre-existing back complaint). btw three weeks is the maximum hospital stay permitted in Korea before a serious inquiry starts into what kind of injury the person has sustained. |

I am as it happens. |

Got a bit more information. Apparently, judges in civil courts take into account the fact that most hospitals support "nylon patients" here so they will not sanction a complete payout of costs. It often maxes out at about 2 million unless it was a real beating with weapons and whatnot. So, the legal fees often outweigh the payout. |

That really sucks! I had similar thing happen with my motorcycle just touching the back bumper of a car. Not even a scratch.
Nevertheless, all 4 passengers and the driver went to the hospital and claimed whip lash, back injuries, and shoulder pain.
Fortunately my insurance covered it all, but I was so pissed off with the obvious abuse of the system. |

I'd imagine that had changed a bit since a couple of years ago when the insurance companies decided that if the "nylon patient" can cruise around town at whim, then said patient is really all that injured and thus no need for said companies to pay out megawon. |

Sounds like a real classy girl. Wasn't a *beep* from Itaewon was it? Ha ha. Either way firing 3 days before the contract would still require a written warning and he should have fought it before the labor board. His loss. |

The hospitals here don't use x rays and cat scans? The Prosecutors office should use their own independant ones to do these things. If it's found out anyone is "faking" injuries, they should be prosecuted and made o repay the cost of the procedure. This would cut down on a lot of BS. |

Just out of curiosity, do they pull this crap in China or can you as a foreigner actually defend yourself? |

I think this what you may be looking for
Quote: |
After the new Criminal Law took effect, the definition of justifiable defense is largely expanded, giving victims more rights to better defend their interests. According to the 1997 edition of the Criminal Law, an act to defend oneself against an ongoing assault, murder, robbery, rape, kidnapping and other crime of a violent nature that seriously endangers one's personal safety is a justifiable defense, and the victims involved shall not bear criminal liabilities when striking back. |
