Employers who don't pay in to the pension scheme

Should I be suspicious of employers who don't make the pension contribution?

I have been told that my prospective new employer wont be making the pension deductions which is fine because as a Brit I can't claim it back anyway.

Is is this legal and should I be concerned about this?

Not cdi, wonderland or anyone like that.

This seems a very grey area with all this talk of independent contractor / freelancer type talk.

This is what they guy who I am replacing said:

"since the school is small we don't need to do the pension
there are two types of hiring employees, and our school hires teachers as a "freelance"with that the employer does not need to opt into the pension program, nor do they need to provide health insurance, but of course our school does health and if a teacher wants pension then we can do it
one of our Korean teachers does the pension program but all other, including myself opted out small schools have this option but the larger schools don't. I don't know the law exactly but i believe its to help out the small businesses
but its nothing to be worried about"

Most other people over FB said I should be concerned.

Sadly, their stunt with the national pension scheme shows that they are like CDI, Wonderland, et al.

Actually, there is not now nor was there in the past a gray area on the issue of the national pension.

The other people over on Facebook are correct. First off, the school's pulling that independent contractor stunt. You may be interested to know that CDI got slammed in the courts for doing that. It's a bogus move.

Second: Small schools not being required to provide health and pension was out-of-date information a few years ago. ttompatz is this board's go to person for current information.

I sure hope you haven't already signed a contract with these scum.

I have not signed anything and have taken the issue up with the recruiter and will go from there.

I actually had the same thing happen with a certain recruiter. Tried to tell me it's the norm these days for hagwons to not pay into pension.
If a recruiter tells you something like this, I would switch recruiters. Mine tried to make me feel bad and picky for wanting a job that paid into pension.
And yeah, I'm sure with those from the UK (from what I've heard you have to wait longer to touch the pension--possibly until retirement?) they try to talk them into taking jobs that don't pay into it.
If the school isn't paying into pension, they're probably cheap.
If you really don't want to pay into pension and decide to take a job like that, make sure they pay you at least 100k more each month to compensate what they would be contributing to your pension.

You can't have medical without pension. So if they are not giving you pension then they are giving you some private medical insurance that might not cover as much as national pension. Don't work for a sketchy school. Who knows what other crap they will try to pull on you.

Sure you can. Here's how it works: your school calls up the national health insurance scheme and pretends they're your legal representative. National health insurance doesn't verify this because that might take effort and/or speaking in English and that would just be too much trouble. Anyway, school (pretending to be your representative) tells health insurance that you're an independent contractor making 1 mil a month. Health insurance guy says OK and then the call is over. It's just that easy. That's how I got screwed out of Pension my first year, when I didn't know better. I made the mistake of calling Nation Health Insurance to verify details and they had no idea what job I had, just that I was an independent contractor making 1 mil a month. So if there was ever an issue with lying to National Health Insurance, it would all come back to me. Those idiots didn't even take down the name of my fake "legal representative."

Any school that does anything this shady (lying to the government on your behalf and throwing you under the bus if you run into problems) on day 1 will make it their goal to do as many illegal and immoral things at your expense to make as much money as possible. Don't sign with anyone doing this.

One more thing - If your recruiter makes one mention of this type of activity being "common" or "OK" don't work with them anymore. There are dozens of recruiters, and even pages here and on Facebook where you can find out about jobs firsthand. Don't give the ones promoting illegal activity the ability to thrive. That just makes the Korea a worse place for everyone.
