I have heard some rumours, especially in Facebook communities, that it might not be legal for E2s to work after school positions.
These revolve around issues such as: the school sponsoring your visa but the after school company hiring you, insurance and pension payments, and being registered as an independent contractor and other often tenuous reasons.
What is the feeling here? Anyone on an E2 working after school? Have you had any problems? Does anyone here know anyone who has been in trouble with immigration for working an after school position on an E2?

A guy I know just got burned in the exact same situation. He worked an after school, and the school 'officially' sponsored his visa, but all pay and bennies were handled through a contractor.
In the end, immigration had questions about his taxes when he went to renew his visa. Why? Because the place sponsoring him and the place paying him were different. The actual school refused to cut him a letter affirming employment or a letter of release so that he could get a D10 and move on. Neither the school nor the contractor wanted immigration to know about the deal they had going.
Oddly enough, at least one, maybe two other E2s working the same deal had no problem with immigration. Very sad situation.
All in all, though, if it seems fishy, avoid it. Most of those programs don't pay all too well, anyway. F-series visa holders will take them for the convenience, and they don't have to deal with immigration. |
