A firend of mine was fired by the whacko hakwan owner a week ago. He had about 6 weeks left on his one year contract as well as his salary cut. What can he do? This is a terrible hakwan, all the Korean teachers have quit in droves. Of course it is all his fault, the hakwan owner said he wasn't a good teacher--this of course more than 10 months into the contract! Info please?!?

Well your friend needs to go straight to immigration and explain what has hppened and ask how much longer he can stay in country. Normally two weeks is allowed provided the time is left on the E2.
The other thing would be for your friend to do a visa run and hand in his alian card on the way out and come back in on a tourist and look for a job in a new area. The chances of getting money from his old boss is slim and takes time and a fair bit of organising so it's better to pretend that you are throwing in the towel and going home and then to change to a different provienc to work after doing a visa run. |

If the hagwon owner has given thirty days notice he is entitled to dismiss this teacher and there is little, sadly, that can be done (as it appears in my view that this teacher has been fired in order to avoid paying him severance) .
Article 32 (Advance Notice of Dismissal)
(1) An employer shall give an advance notice to a worker at least thirty days before dismissal(including dismissal for managerial reasons). If the notice is not given thirty days before the dismissal, normal wages for more than thirty days shall be paid to the worker, except in cases, prescribed by the Ordinance of the Ministry of Labor, where it is impossible to continue a business because of natural disaster, calamity, or other unavoidable causes, or where a worker has caused considerable difficulties to a business, or damage to properties on purpose.
However if this grace period has not been given a trip down to your local Ministry of Labor office is a good idea for a list of regional offices go to

Basically all the laws state that the hogwon owner must do this, and that. But don't expect to get ANYTHING. Same thing happened to me in my 10th month...F'n scumbags. |

Pocket size recorders are extremely cheap in Korea. Your friend should buy one. He should have a discussion with his boss and record it. For example;
Recorded prior to having the conversation without hagwon owners knowledge
My name is:
My employer's name is:
The school name is:
The school address is:
The school telephone number is:
Conversation questions:
Why was I fired?
Were there written complaints from parents?
Were there written complaints from students?
Were there written complaints from staff?
Why was I fired on date fired on?
-Make several copies of the tape. It sounds like your friend was fired for bogus reasons. If the employer sets himself/herself up for a fall during this conversation, it may be a good idea for your friend to play this to someone at the labor board when he files. It can only help and not hurt. |

Where are the scum bag apologists? Let's hear again how wonderful Koreans can be...
Your friend will get his last salary and airplane ticket? What exactly did your friend get paid after the firing? I would file at the labor board and talk to immigration...and expect a long fight to get anything. It is possible to get a ruling at court and then do a property seizure but you need a smart Korean's help.
You can file a claim at the police station against the owners...could take 3 months and you need a Korean's help. With this ruling from the police it is possible to do a property seizure. (You need to make a statement and have some proof like your contract pay statements (translated in Korean). |
