Let's just say the school I work for is not the best. There have been times when they have, hmmm, cheated and lied to the teachers, foreign and korean. Surprise, Surprise.
My conundrum is this, the return ticket the school bought for me expires Dec 11 (saturday), my alien card/visa expires Dec 12(sunday), but my contract (which apparently isn't worth the paper and ink used to print it) expires Dec 13 (Monday). I don't work weekends.
Now, I want to leave this school as soon as possible, but I want to make them pay the severance as well, given all the teachers they've screwed in the year I've been here. Also I don't want to lose the return airfare.
Can they try to not pay the severence if my contract expires Dec 13 but my visa/alien card expires Dec 12 and I leave on Dec 11? Does it make any difference that I arrived in country Friday night so I didn't start work until Dec 15 2003?
If they can refuse to pay the severance, they will. |

Well, if they are responsible for paying your way back, then they have a choice: (A) Let you go when their ticket requires you to leave, Dec. 11, and pay everything they're supposed to, including severance, or (B) if they insist you stay to the end of the contract to get your severance, then they have to fork out money for a new ticket.
That seems what is right anyway. Can they get away with doing something unfair in this situation? Probably. |

It sounds like they will want you to work right up until your last day. They can get an extension on your ARC, it might be worthwhile chatting with the director, even though the director can be deceitful. You need to know, so that you can change your departure date and that may be a good bargaining point, that to change the ticket will incur a substantial monetary penalty. Look for options.  |
